on the North by York Street, ON the Ewt by Boyd Street, on the South by
Hancock Street, and on the West by Essex Street, being more fully described
as follow:
Beginning at the intersection of the easterly right-of-way line oY Essex Street
and the southerly right-of-way line of York Street; thence North 600 18' h8"
East along the southerly right-of-way ]in e of York Street for a distance of
855.73 feet to the westerly right-of-way line of Boyd Street; thence along
the westerly right-of-way line of Boyd Street, South'250 20. 50" East for a
distance of 332.32 feet, and South 140 35' 51" East for a distance of 103.06
feet, to the northerly right -of -may line of Hancock Street; thence South
670 53' 43" West along the northerly right-of-way line of xancock Street for
a distance of 910.40 feet to the easterly right-of-way line of Essex Street;

the point of beginning. This exception is expressly limited to land and
impmv®ents located within the land described in this paragraph. all

HE IT FURTHER RESOLVED by the City Council of the City of Bangor That, in
accordance with independent appraisals of value of the above-described
property, the Brandt of damages determined to be Just caspeneation for the
acquisition of the outstanding interests in the above-described property is
L2.)2 for the DOROTHY MCINTOSH MIRE, $1.00 for IT25 3 [0.VS OW, and
1.00 for the revolving -interests.
STAT®61PP OF FACT: 30 M.R.S.A, 94854 authorizes municipalities to acquire
by eminent domain property, or interests therein, in designated slmm or
blighted areae. Inorder to exercise this power, the Bangor City Council
must first adopt a "Resolution of Condemnation" to be served upon the
property owner(s). After -service is completed and a public hearing odver-
tised and held, the Resolatlon is resubmitted to the City Council for its
approval or disapproval. Condemnees who receive personal notice then have
three months in which to appeal the City's taking; cord® aes who do not
receive personal notice have twelve momboa in which to appeal the City's
tahi4g.

Attached is a copy. of a City Council Orrlet to 'initiate a perimeter
®inert domain action to cure the residual title problems in the Hancock -
York Disposition Parcel H-1 to permit its redevelopment. Like the pa pious
Cassmsnity Development eminent domain action the City Council has con-
sidered, this is a two step process and a second Council Order will be
introduced at y meeting of August lath. I have explained this to
Councilor ZemAzim who has agreed to sponsor the Order.
