AND BE IT FURTHER ORDAINED THAT Chapter VIII, Article 21, Section 10, Subsection (3) be emended by adding to the lest sentence: "unless the Board wishes to make adeeision to either approve o di9approve the application: AND BE IT FURTHER ORDAINED THAT Chapter VIII5 Article 21, SWUM 10, Subsection (3), (e) be amended by adding the following: "No certificate of occupancy shall be issued by the Code Efiforcement Officer unless all improvements shown on the Site Plan including Greening, planting, and landscaping are completed. In the event that some elements of the Site Plan cannot be completed because of circumstances beyond tho'uontrol of applicant (each asvail- ability of materials oz$dverse weather), a temporary certificate of occupancy may be issued by the Code Enforcement officer provided that: 11 1. A surety bona is posted with the City of Saeger in a form approved by the City Solicitor. 2. The am nst of the canary bond is that amount necessary to complete the unfLuahed building and/or site Improve- ente based upon, and equal to, cost estimates prepared by or approved by the City Engineer. The temporary occupancy permit shell be issued to expire at a date certain, by which date the applicant must have procured a permanent ertifieats of occupancy from the Code EnforDement Officer. If this requirement is hot met, than the Performance Bond is forfeited and the -City of Sanger, or its agent, shall have the right to enter applicant's property and Complete the neceaeary dmperovessents with - the proceeds of the bond. At any Board review or Hearing, a party may be represented by an Attorney or other representative. Any person may file with the Planning and Community Development Director a written request for a Public Hearing. Any scheduled hearing shall not be continued to another time except for good cause, and when such continuance is requested by the applicant, all advertising costs shall be borne by the applicant.
