ORDERED;
THAT WHESEA.S, the City has received notification that the tentative
developer of the Barger Waterworks Facilities is unable to proceed with his
proposed development: -
POWs THEREFORE9 BE IT ORDERED THAT the City Manager is hereby
authorized and directed to solicit propoaels for the acquisition and reuse a
the Banger Waterworks facilities; and
BE IT FURTHER ORDERED THAT a Design Review and Site Plan Review
Committee ard procedures for redevelopment of the Ranger Watenerrke Facilities
be established as follows:
A. Disposal of Lend
1. Metbod of Disposal -The City may dispose a the Bangor
Waterworks Facilities by sale or lease in accordance with
any method permitted by State and local lam to a developer
selected by competitive proposal. Reservers prior to the
execution of any agreements, the City Council shall by
resolutions council order or similar action:
a. Approve all agreements end conditions thereon and
b. Approve the price.
2. Desiun Committee - A Design and site Plan Review Co®ittees
consisting of the menmers of the City Connell Cosmoovity
Development Committees the Chairman of the Pluming Boards
the City Managers the City Engineers the Director of Planning
and Co®unity Developments and the Planning Officers shall
review and evaloate all redevelopment proposals submitted.
The Design Co®ittee shall submit its reessumendations for
the selection of a tentative developer to the City Council
which shsll adopt a resolution designating the tentative
developer.
3.. Option to Purchase - The City shall a as practical
enter into an agreement with the tentativedeveloper
providing him with an option to purchase. The City shall
also indicate in the agreement the time limits fora b -
mission of final plans, penalties, if ages renewal¢ and
extensions.
4. Redeveloper`s Qualifications - Before executing say final

redeveloper possesses the qualifications and financial
resources to acquire and develop the land and property in
accordance with his proposal. The agreement for transfer
of land will contain the qualifications that the construction

developer as part of the agreementto post a performance
bond i¢amount to be set by the City. The City may at
its discetion, end for good cauce, reject any perspective
redeveloper based an an analysis of pertinent data relating
to his qualifications.
B. Approval of Plan
No construction or renovation will be allowed without the prior
submission and approval of preliminary, plans, final plans and specifications.
Said plans shall be reviewed by the Design Camandttee to ensure consistency
in design and compatibility with the proposal accepted by the City Council.
No plana shall be approved unless said plana have been prepared by a duly
registered architect as defined by Title 32 of the Maine Revised Statutes
Annotated, unless offbai ice accepted by the City.
