The above described alteration is shown on a Plan prepared by the City of Bangor Engineering Department entitled "Stillwater Avenue Right -of -Way", Plan No. R-876 dated April 10, 19791 to be recorded in the Penobscot Registry of Deeds. The land to be taken, and the existing right-of-way to abandon as a result of said right-of-way alteration is described as follows: - Banaor Mikveh Association, Penobscot Registry of Deeds, Vol. 1588, Page 81: Beginning at the intersection of the existing northerly right-of-way line of Stillwater Avenue and the westerly right- of-way line of Pine Street; thence South 78 42' 17" West along said northerly line of Pine Street for a distance of 59.94 feet to a point, being on the westerly ling of said Bangor Mikveh Association property; thence North 11 17' 43" West along said westerly property line for v distance of 3.51 feet to a point, -2- ---being on the proposed new northerly right-of-way line of North Park Street; thence in a generally northeasterly direction along said proposed northerly right-of-way line, being a curve to the left having a radius of 424.28 feet, for a distance of 61.21 feet to a pointe n the westerly right-of-way line of Pine Street; thence South 11 17' 43" East along said westerly line of Pine Street for a'distance of 15.73 feet to the point of beginning. Although the roadway is to be reconstructed; there is no Appreciable grade changein either North Park Street or Still- water Avenue. -3- There appeared at the time and place set for the meeting Rabbi Heney Isaacs, representing Bangor Mikveh Association Mr. Sidney Epstein, Attorney Paul Rudman representing Mr. ipstein, and Mr. Peter Downey, a resident of 252 Center Street. Those present were advised of the direction given to the City Engineer to alter the right-of-way by the subject Council Order and advised those present that the right-of-way alteration is considered necessary (1) to provide an additional traffic lane between Broadway and Pine Street, and (2) to provide a smoother and safer transition between Horth Park Street and Stillwater Avenue. With regard to the latter, those present were advised that the City Engineer will recommend that the name of North Park Street between Broadway and Pine Street be changed to Stillwater Avenue, so that, in effect, Stillwater Avenue will extend all of the way to Broadway. Those present were also advised that bids for the construction of the roadway were scheduled for receipt within a few days, and that it was imperative that the right-of-way altera- tion be completed as quickly as possible. Mesa present were advised that no benefits would be assessed to the property owners as a result of the reconstruction of the roadway, and they were also advised as to the recommended damages to be paid for the land to be acquired, as described above. Rabbi Isaacs was advised that the existing hedge in front of the bath house on the Sensor Mikveh Association property would be relocated to the new right- of-way line. Rabbi Isaacs expressed a concern as to possible damage to the existing concrete tanksin the bath house as a result of the construction, and he was advised by the City Engineer that care would be taken to prevent any undue vibration in the vicinity of the bath house during construction. Those present were advised that an appeal would be made to the City Council Finance Committee if they were dissatisfied with the recommended damages. However, through subsequent conversations, the recom- mended damages were accepted by the parties involved. Mr. Downey expressed a concern as to the possible increase of traffic on Congress Street as a result of the construction of the new roadway, and felt that action should be taken to make all or part of Congress Street one-way. Mr. Downey was advised that in the opinion of the City Engineer the increase of traffic flow as a result of the project was not relevant to the proposed altera- tion in the right-of-way lines, but suggested that any alterations in the traffic flow should be considered separately by the Planning Board or the City Council Public Safety Committee. It is recommended that the right -o£ -way alteration be laid out as described above, and that the name of the street be changed to Stillwater Avenue for the entire distance to Broadway, and that the Official City Map be revised accordingly. -A- A copy of the right-of-way Plan is on file in the office of the City Engineer.
