Sewall Company for the final design of the Penobscot River Interceptor Sewer Extension, said Proposal dated January, 1979, and WHEREAS, application has been made to the Environmental Pro- tection Agency and the State Department of Environmental Protec- tion for funding for the final design of the project, and WHEREAS, said EPA and DEP require an amendment to the Sewall Company Proposal to establish the profit as a fixed amount rather than a percentage of theactual design cost, NOW, THEREFORE, be it ORDERED, that the City Manager be and hereby is authorized to accept the attached Amendment from the James W. Sewall Company, to be incorporated as part of their original Contract. STATEMENT OF FACT: This Amendment will not increase the design cost over the original "not to exceed" amount specified. Frawley City Engineer City Building Bangor, Maine 04401 Be: Project C 23-0154 Penobscot Interceptor Technical Services Agreement Dear Mr. Frawley: In response to DEP's letter to you dated April 19, 1979, we have since requested clarification from both DEP and EPA relative to their current In- terpretation of requirements under CFR 35,937-1(b) pertaining to cost r bursement and the so-called "profit fee" in Technical Services Ayyr ementsm Both agencies now indicate this fee (line 11 of EPA Form 5700-41) should be stated as a fixed amount rather than as alimiting ornot-to-exceed" amount as e had proposed in the above -referenced agreement and as we have used in prior agreements approved by EPA. The logic behind this requirement is somewhat obtuse and beyond my Anil- ity to describe without adding to the confusion. While we de not necessarily agree with that logic, we acquiesce to the Agency requirement and request that you consider this letter as amending the agreement such that the amount shown on Line 11 of Form 5700-41 contained therein is considered a fixed fee. We also enclose a labor -Four and cost -breakdown for each Item of the agreement for your reference and.fortransmittal (3 copies) to DEP. If the proposed amendment i acceptable, It should be acknowledged by signature of the City's authorized representative in the space provided below.
