ORDERED,
TEAT the City Manager is hereby authorized and directed, on gala if
of the City of Bangor, to execute a Joint Memorandum of Understanding with
the stateofMaine Department of Environment Protection for purposes of
conducting a street vacuuming program for purposes of seeking a solution
to existing afi quality problems in the dountowa area.

located in Penobscot County, State of Maine, and the STATE OF MAINE DEPARTTffiiT
OF ENVIRONMENTAL PROTECTION, an agency of the State of Maine having its principal
office in .Augusta, County of Kennebec, State of Maine.
WITNESSETH:
WHEREAS, the City of Bangor has been designated as a nan-attainment
area for total suspended particulate (TSF) under the Federal ambient air quality
TSP standards; and
4MEREAS, as a result at this non -attainment designation the State of
Mein Department of Environmental Protection (DEP) has submitted a revision to
its State Implementation Plan which provides for attainment with said Federal
standards as expeditiously as practicable, but not later than December 31,
1982; and
WHEREAS, as a result of a study and report, dated July, 1979, prepared
for the DEP by GCA Corporation, Bedford Masaachusetts, it has been determined that
an eight month vacuuming program is the only option available to the City
of Bangor to achievethenecessary.. particulate
WEEPERS, both parties agree to operate and conduct said program in
accordance with the.understandings expressed herein,
NOW, THEREFORE, the City of Bangor and the State of Maine Department
of Eovinonmeotal Protection, through their authorized representatives, enter
into this Memorandum of Understanding, as follows:

The purpose of this Memorandum is to:
a, establish and set forth procedures and responsibilities
for each party to be followed in the implementation of an eight month vacuum
street sweeping program in the City of Bangor; and
b. establish and set forth procedures for making a determination
as to the effectiveness of said vacuum street sweeping program.
II.
PROCEDURES AND
RESPONSIBILITIES.
The procedures
and responsibilities
of
the
parties
under
this
Mamorande, are as follows:
A. The City of Bangor, at the request of DBP, will provide
all available information concerning past and present street programa existing
at the time of execution of this Memorandum.
B. The City of Bangor has issued purchase orders for the procurement
of a new vacuum street sweeper and will use its best efforts to obtain delivery
of said vacuum street sweeper no later than March 31, 1980.
C. The City of Bangor will begin its vacuum street sweeping program
no Later than April 1, 1980, or as soon as it receives delivery of said sweeper,
whichever occurs last.
D. The City of Bangor will conduct a street sweeping vacuum program
for a period of eight months after receipt of said vacuum sweeper. In the
Central Business District the program will be conducted weekly; the remaining
streets will be vacuumed no less than bi-monthly.
E. During the period of the program, the DEP will maintain a
network of TSP monitors in the Bangor/Brewer area designated to reflect the
statue of ambient air quality and the effectiveness of said vacuum street
sweeping control program.
P. During the period of the program, the DEP will provide the
City of Bangor with a monthly summary of Its air quality monitoring results,
including basic data findings: and shall indicate specifically all findings ..
which it construes to violate federal ambient air quality standards.
G. Staff representatives of bath the City of Bangor and the DEP
will meet at least once every three months to evaluate the effectiveness of
said street vacuum program and to determine whether alternative controls are
needed.
H. In all future analyses of whether attainment with said
Federal ambient air quality standards has been met in the City, the City of
Bangor and the DEP will jointly determine whether compliance has been achieved.
