And that the said City Engineer met at the time and place of meeting apeciOM in tbs unties¢ and proceeded W lay out sa2d Ppoirriew Avenue Fztcu aiou,__. as follows: -1- Beginning at a point on the easterly right-of-way line of Parkview Avenue located 920 feet north from the northerly right- of-way line of Mount Hope Avenue, said point being the northerly terminus of the Parkview Avenue right-of-way as laid out on September 10, 1907 and recorded in City of Bangor Road Book Vol. 3, Page 384; thence in a northerly direction along an extension of the easterly line of Parkview Avenue for a distance of 56.00 feet; thence in a westerly direction at right angles to the last described line for a distance of 48.00 feet to a point, said point being on a northerly extension of the westerly right-of-way line of Parkview Avenue; thence in a southerly direction along the extension of said westerly right-of-way line of Parkview Avenue for a distance of 56.00 feet to a point, being at the northwesterly terminus of the Parkview Avenue right- of-way as originally laid out; thence in an easterly direction along the northerly terminus of said Parkview Avenue right-of- way as originally laid out for a distance of 48.00 feet to the point of beginning. Meaning and intending to describe an extension of the 48 foot wide right-of-way of Parkview Avenue for a distance of 56 feet in a northerly direction from its existing northerly terminus, said ertension being on land now or formerly owned by Owen P. and Jeanette A. Towne, as described in a deed recorded in Penobscot Registry of Deeds, Volume 2318, Page 251. There appeared at the time and place set for the hearing, Mr. and Ere. Owen Towne of 295 Parkview Avenue; Mrs. Percy H. Gallison of 287 Parkview Avenue; Mrs. Robert 0. Walls of 239 Palm Street; and Mrs. Leroy Grondin of 288 Parkview Avenue. The City Engineer explained the purpose of the public hearing: To comply with the provisions of the State Statutes for laying out and acquiring the right-of-way for the street extension. He further explained that the reason for extending the right-of-way was to encompass the portion of the Parkview Avenue roadway which is actually being used by the public and by the neighborhood residents. The paved roadway has been plowed and maintained as an unaccepted street for a distance of approximately 56 feet beyond the actual terminus B the public right-of-way, primarily as a result of the need for access to the house of Mr. and MTs. Towne, located at 295 Parkview Avenue. It was also noted that a garage owned by Mr. and Mrs. Gallison of 287 Parkview Avenue is actually beyond the end of the existing right-of-way. It was explained that the public maintenance of so-called "unaccepted Streets" is not uncommon in Bangor, where houses had been built beyond estab- lished right-of-way limits. The City Council has previously established a policy of providing minimum maintenance on such streets. The City Engineer indicated that he would recommend no payment of damages for the right-of-way acquisition, since the right-of-way only encompasses the roadway area which has -2- existed for many years, and will not encroach upon any private improvements. He also stated his belief that the right-of-way extension is actually a benefit to the properties which it abuts, since it provides public right-of-way access, making their properties more valuable. Mrs. Towne asked if there were any plans to extend the right-of-way further. The City Engineer indicated that there were no plans, and he would recommend against any such extension, since a further extension would intersect the front of the Towne house, as well as other improvements to their property in front of the house, there would be no practical benefit to the public by such a right-of-way extension. It is recommended that the extension of the Parkview Avenue right -of -wag for a distance of 56 feet in a northerly direction be accepted as a public way, and that it be added to the Official Map, to be named and known as Parkview Avenue. A Plan showing the Parkview Avenue right-of-way extension is on file in the Office of the City Engineer.
