HomeMy WebLinkAbout2012-11-26 13-027 ORDINANCECOUNCIL ACTION Item No. 13 ,0 2 7 Date: November 26, 2012 Item/Subject Ordinance, Amending Chapter 165, Land Development Code, of the Code of the City of Bangor, Section 165-66 — Zoning District Boundaries Commentary: The proposed Ordinance amendment is intended to provide more flexibility in how a property located in a commercial or industrial development zone would provide for a transition yard or buffer between their development and an adjacent residential property. The present standard requires a minimum of 20 additional feet of setback which can render a significant portion of a commercial lot nonbuildable especially if the existing setback is 25 to 30 feet wide. This item will be reviewed by the Planning Board at its December 4, 2012 meeting. Ordinance, Amending Chapter 165, Land Development Code, of the Code of the City of Bangor, Section 165-66 — Zoning District Boundaries NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, That Chapter 165 of the Code of the City of Bangor be amended as follows: § 165-66 Zoning District Boundaries Where the side or rear lot line of a lot in a Neighborhood Service District (NSD), Urban Service District (USD), Airport Development District (ADD), Urban Industry District (UID), Government and Institutional Service District, (G & ISD), Shopping and Personal Service District (S & PS), General Commercial and Service District (GC & S) or an Industry and Service District (I & S), Technology & Service. District (T & S) abuts any residential district, a Resource Protection District (RP) or a Park and Open Space District (P & O), a transitional yard will be established in accordance with the district development standards, and any applicable side e€ or rear yard building setback shall either be increased by 20 feet -,end with at least a Buffer Yard $-A (as defined in § 165-135D) established, or be increased by 10 feet with at least a Buffer Yard B , established. Any applicable side or rear parking setback shall be governed by §§ 165-73D(ii. Additions are underlined, deletions struek through.
