Commentary:
This Ordinance will amend Chapter 85 of the Code of the City of Bangor to allow for five year
automobile recycling permits. Under the current City Ordinance automobile recycling licenses
are issued annually. However, in 2004, the State law was amended to allow recycling businesses
to license for a 5 year period. If approved, this amendment will allow the City Clerk's office to
issue five year recycling licenses and set the fee at $300, which is equivalent to five one-year
licenses under the City's current fee schedule. f
This amendment will bring the City's ordinance in line with state law while also reducing
paperwork and saving the business owner four year's worth of advertising fees, or nearly
$1,000.
Further, State law also now requires these licenses to be issued on an October to September
schedule, rather than the January to December schedule of most licenses. The Clerk's Office will
pro -rate the cost for any renewal licenses this year so that City license periods come into
alignment with State law.

(TITLE.) Ordinance, Amending Chapter 85, Business Licenses, of the Code of the City of Bangor, By
Allowing Five Year Automobile Recycling Permits
WHEREAS, under State law, municipalities may grant automobile recycling businesses permits that
last for five years;
WHEREAS, allowing these businesses such a license will help the City eliminate unnecessary work for
the City Clerk's office and qualifying business applicants;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS,
Chapter 85 of the Code of the City of Bangor be amended as follows:
§ 85-4. Fees.
B. The fees to be charged for such licenses and permits shall be as follows (increased by rounding off
to the nearest dollar for computation purposes):
License or Permit Fee
Industrial metals/junkyards $60
Automobile recycling $300
§ 85-6. Expiration date.

A. Unless otherwise provided by law, all of the foregoing licenses and permits shall expire 365 days
from the date of issuance.
B. Subject to the requirements of § 85-5 above, any applicant operating a business following
expiration of or without obtaining a license or permit required by this chapter shall, upon
application, be granted the license or permit concerned, but such applicants shall pay all license

and permit fees that would otherwise have been payable for the period the applicant operated its
business without the required license or permit. Such fees shall be in addition to the annual fees
paid by the applicant under § 85-4 above.
C. Notwithstanding Section A above, beano and garnes of chanee lieenses shall expire thFee yea

D. Notwithstanding the period of the license or permit for automobile recycling, all automobile
recycling facilities shall be inspected -by the appropriate Departments) of the City annually on the
anniversary date of the issuance of a license or permit.
