While these events are unlikely, in order to be prepared for the possibility, the Maine Center for Disease Control and Prevention (Maine CDC) would like to enter into an agreement for the use of the Civic Center in such an emergency. The proposed Memorandum of Understanding would allow Maine CDC to use the Civic Center for large-scale dispensation of pharmaceuticals if a severe public health emergency were to occur. This Memorandum would be in effect as of November 1, 2012, and would terminate on May 15, 2013, as the Civic Center will be torn down shortly after that date. A new Memorandum will be needed for the Cross Insurance Center if it is to be used in a similar manner. Purpose This Memorandum of Understanding is between the Maine Department of Health and Human Services, Maine Center for Disease Control and Prevention(hereinafter Maine CDC) and the City of Bangor(hereinafter the"City), owner of the Bangor Civic Center and Auditorium, (hereinafter Bangor Civic Center) a facility that may serve as a open Point of Dispensing(open POD). The agreement is a component of a statewide response plan for biological, chemical or radiological events or other large-scale public health emergencies if they occur in Maine. Maine CDC is currently developing MOUs with other facilities across Maine. In the event of a large-scale public health emergency requiring the deployment of SNS assets, the Maine CDC shall determine which PODs are the most appropriate to be activated. The determination shall be based upon the nature of the emergency and public health objectives in response. The City agrees that the sole determination of the existence of a qualifying public health emergency shall lie with the Maine CDC, in conjunction with the Governor's Office and the Maine Emergency Management Agency. II. Definitions Strategic National Stockpile (SNS): The mission of the SNS is to ensure the availability of critical medical assets at the scene of any severe public health emergency. At the Federal level, management of the SNS program is the responsibility of the U.S. Centers for Disease Control & Prevention(U.S. CDC). Within Maine, Maine Department of Health and Human Services (Maine DHHS), Maine Center for Disease Control and Prevention(Maine CDC), is charged with SNS preparedness and response. The SNS program manages large quantities of pharmaceuticals and medical supplies to protect the American public if there is a public health emergency (e.g., terrorist attack,pandemic influenza(PI) outbreak, earthquake, etc.) severe enough to deplete local supplies. Once Federal and State authorities agree that the SNS support is needed, a Push Package containing a broad spectrum of pharmaceutical and medical supplies may be delivered to the state within 12 hours. Specific pharmaceuticals and medical supplies held within the U.S. CDC's Managed Inventory may also be requested and would arrive in the State between 24-48 hours after requested. Each state has plans to receive SNS assets at Receipt, Staging, and Storage (RSS)warehouse(s) and distribute them to impacted local communities as quickly as possible. 1 13 007 Severe Public Health Emergency: Any incident that poses a threat to the health of the community, which exceeds the capacity of local and state resources to respond. Such incidents could include, but are not limited to, naturally occurring disease epidemics/pandemics, natural disasters, and the intentional or accidental release of chemical agents or biological pathogens. Open Point of Dispensing(open POD): Clinics designated to rapidly dispense pharmaceuticals and/or administer vaccinations in a severe public health emergency to impacted public populations who are not ill as a result of the emergency event. III. Ongoing Responsibilities The City agrees: a. To provide emergency Point of Contact(POC) information to ensure timely notification of the City in the event of a severe public health emergency. b. To allow the Bangor Civic Center to be utilized as an open POD for the dispensing of pharmaceuticals and/or provision of vaccinations in the event of a severe public health emergency, at such time that the Maine CDC specifies. c. That it may be necessary for the Bangor Civic Center to cancel activities for the duration of the POD operations. d. To secure any unused pharmaceuticals and/or medical supplies until a time the Maine CDC can make arrangements for retrieval. e. To provide site-specific information requested by Maine CDC, including floor plans, inventories of relevant durable property (such as tables, chairs, and refrigerators), HVAC schematics, and other detailed building plans as are available. Maine CDC shall not request or hold copies of the building keys. f. To, upon reasonable notice and during normal business hours,be available for visit by members of the Maine CDC and its SNS partners, for the development and maintenance of a site-specific POD plan. g. To,upon reasonable notice and during normal business hours, and with the consent of the City, be available to Maine CDC for the purpose of conducting training and exercise. h. To provide Maine CDC written notice,within 30 days, of any major alterations, renovations, or damage to the facility that might affect its use as a POD. i. To provide Maine CDC written notice,within 30 days, of any change in ownership. Maine CDC agrees: a. No modifications or changes shall be made to the Bangor Civic Center's property without the express written approval of the owner of the City. 2 13 007 b. To coordinate with local law enforcement to keep the facility property secure and free from damage. c. To provide pharmaceuticals and/or vaccinations to the staff of Bangor Civic Center, as well as their families, in advance of the opening of the POD. d. To clean the property after use, including: removing all trash, placing tables and chairs in their original locations. e. To make arrangements to collect, in a timely manner, any unused pharmaceuticals and dispensing supplies. It is mutually agreed that: a. This Memorandum will not supersede any laws,rules or polices of either party. b. If activated the POD site would likely be in operation for 3-5 days. However, the duration of site operations shall be directed by the scope and nature of the incident, and shall be determined by the Maine CDC, MEMA, and the Governor's Office. c. This Memorandum will go into effect only at the request and direction of the Maine CDC. d. Immediately prior to occupancy, representatives of both parties shall inspect the facility and shall note any discrepancies on the Pre-Occupation Checklist included as a part of this agreement. e. Prior to vacating the facility,representatives of both parties shall inspect facility to note any discrepancies on the Pre-occupation Checklist. IV. Reimbursement for Use of Facilities The City is providing its facility at no charge to the State of Maine. The State of Maine does not bear any costs associated with the payment of rent for the use of the facility. If federal disaster relief funding, or a comparable source of funding, is made available following the emergency, Maine CDC will consider reimbursement of Bangor Civic Center for the use of their facility and equipment in response to the emergency. V. Duration and Review of Agreement This Memorandum is effective November 1, 2012 and shall terminate on May 15, 2013. This Memorandum can be amended by mutual agreement of both parties at any time and may be terminated by either party upon 30 days' notice in writing to the other party. 3 J. .) 0107 This agreement does not create a partnership or joint venture, and neither party has the authority to bind the other. Walking through the facility and noting exact locations and types of pre-existing damages on the grid below can do this. After completing the walk-through, the document should be signed and dated and given to the health department representative on-site (you may want to make a copy for your records).
