HomeMy WebLinkAbout2012-11-26 13-023 ORDINANCE COUNCIL ACTION Item No. 13 0 2 Date: November 26, 2012 Item/Subject: ORDINANCE, Amending Chapter 85, Business Licenses, of the Code of the City of Bangor, By Changing the Expiration for Beano and Games of Chance Licenses to Three Years Responsible Department: Clerk Commentary: This Ordinance will amend Chapter 85, Business Licenses, to provide for three year licenses for Beano and other games of chance. Community organizations that operate beano games have asked whether the City could approve their operation for a period of three years, as opposed to the one year currently allowed by ordinance. This is permitted under state law and is currently the practice of many other communities. Since the City does not charge for these licenses, there will be no effect on City finances. This item will be reviewed by Government Operations at it's December 3, 2012 meeting. Ordinance, Amending Chapter 85, Business Licenses, of the Code of the City of Bangor, By Changing the Expiration for Beano and Games of Chance Licenses to Three Years WHEREAS, under State law, nonprofit organizations may operate games of chance or beano games; WHEREAS,the State requires municipal approval before allowing such games; WHEREAS,the municipal license granted by the City currently lasts one year; WHEREAS,the City has traditionally not charged for such licenses; WHEREAS, allowing the municipal license to last longer will reduce paperwork requirements for applicants and the Clerk's office; and WHEREAS, many municipalities in Maine allow for three year approval of such licenses; NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, That Chapter 85 of the Code of the City of Bangor be amended as follows: §85-6. Expiration date. A. Unless otherwise provided by law, all of the foregoing licenses and permits shall expire 365 days from the date of issuance. B. Subject to the requirements of§ 85-5 above, any applicant operating a business following expiration of or without obtaining a license or permit required by this chapter shall, upon application, be granted the license or permit concerned, but such applicants shall pay all license and permit fees that would otherwise have been payable for the period the applicant operated its business without the required license or permit. Such fees shall be in addition to the annual fees paid by the applicant under § 85-4 above. C. Notwithstanding Section A above. beano and games of chance licenses shall expire three years from the date of issuance. Additions are underlined, deletions strettek--threugh.
