Update: Quarterly Abatement Report – 2 Quarter 2019 Amanda presented the quarterly abatement report. Vote: No Action Required 2. Amending Chapter 257 Sidewalks, by Amending Procedures for Permitting Above Ground Utilities in the City’s Right-Of-Way John explained this was for permitting of above ground utilities within the right-of-way. Cell services providing 4G- 5G services that were small attachments that would go onto Emera or Fairpoint utility poles instead of old radio towers previously used. Cathy Conlow stated the FCC made a determination that they have the right to do this and municipalities are to determine a process. The City was working with the MMA to develop a draft model ordinance. She also would like the ordinance to address permit length and the use of the standard decorative lights. Councilor Gibran questioned charging of fees and it was explained there were laws specific to the amount that could be charged. He also expressed concern about having an ordinance in place indicating what would and would not be allow in the downtown district, so that the City had backup from the Council. Cathy explained they came to an agreement to a design review committee made up of Planning, Code, HPC to help maintain the standard and uniform look of the downtown area. She also stated the government had declared this was necessary infrastructure and did not allow municipalities to slow down the process. Councilor Gibran would like further discussion and would like to hear about the law suits around the country. Vote: No Action Required 3. MDOT Agreement: WIN #23521.00, Resurfacing Portion of State Street John explained this was a mill and fill project for 2021 on State Street from Hancock Street to Hogan Road, approximately one mile. Nearly one million dollars project with the City’s portion being 10 percent match. Eric stated in the meantime, Public Works would be patching until then. Councilor Gibran asked about Hammond Street Union Street project. John stated it was Bangor Water District project expected to be completed late August, early September. Thereafter they will be working on Ohio Street. Meeting Adjourned 1
