Fern Street from Urban Residence 1 (URD -1) to Urban Residence 2 (URD -2).
Summary
Rock Maple Holdings LLC., of Winterport, Maine seeks to re -zone approximately .08 acres of land on the
corner of Fern and Garland Streets from the URD -1 which is a single-family zone to URD -2 which allows the
creation of more units. The applicant wishes to put a second unit on the property and would need the
rezoning to allow this.
Adding additional housing units in the downtown neighborhoods remains a stated Council Goal. The
Comprehensive Plan shows this area as single-family dwelling zoning.

ORDINANCE, Amending Chapter 165, Land Development Code, District Map, by changing the Parcel of Land
addressed at 85 Fern Street (Map 54, Lot 129) from Urban Residence 1 to Urban Residence 2.
WHEREAS, at present, the neighborhood of Fern and Garland Streets in this block are mostly single family;
WHEREAS, in order to provide for more housing units where infrastructure and lot size can support the
additional unit;
WHEREAS, the City Council has a state goal of providing more residential units in the city neighborhoods;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
Chapter 165 of the Code of the City of Bangor is amended as follows:
The Zoning District Map is hereby amended by changing the Parcel of Land located at 85 Fern Street (Assessor
Map 54, Lot 129) from Urban Residential 1 (URD -1) to Urban Residential 2 (URD -2).

Map Amendment Change 85 Fern Street
Please accept this memorandum as the recommendation from the Planning Board for the noted item.
The Planning Board considered this item in a noticed public hearing on February 16, 2021.
The meeting was conducted using the city's Zoom account.
The applicant, Sean Hutchinson, reviewed the application. He is seeking the change to allow for a
two family dwelling.
There was some discussion of whether it previously was a duplex; there are indications that it was
previously converted. Board members noted there are other multi -family dwellings in the area that
have not sought this proper designation.
The Board passed a motion, by roll call, made by Member Brush and Seconded by Member Meagher,
to recommend to the City Council that the said zoning district change ought to pass. All members
voted yes.
Under another agenda item on short term rentals, a noticed abutter to the 85 Fern Street subject
project did speak with some concerns regarding providing adequate parking for the additional
dwelling, noting that parking in the neighborhood is a concern. He was encouraged to bring this
comment to the City Council at their meeting February 22, 2021 either by email before the meeting
or at the meeting.
