Authorizing Execution of a Contract with Lou Silver Construction Company in the Amount of $275,000 for
Emergency Repair of Kenduskeag Stream Retaining Wall
This Order would authorize the execution of a contract with Lou Silver Construction Company to perform emergency
repairs on a section of the Kenduskeag Stream retaining wall. At the November 2, 2020 Finance Committee Meeting, the
City Engineer discussed the need to repair the Kenduskeag Stream retaining wall as soon as possible to avoid future
damage to the 42” sewer main that parallels the Kenduskeag Stream immediately behind the wall.
Staff has worked closely with staff from Army Corp and DEP to develop a solution that addresses the City’s immediate
needs while being supported by these regulatory agencies. Initially, the City considered placing heavy rip rap against the
existing retaining wall to stabilize the existing retaining wall. This option was not favorable to Army Corp because of the
extent that the riprap would have to be placed into the stream channel.
In working with engineers from CES and Barney Silver, a plan was identified to construct a gabion wall to be against the
existing retaining wall. The footprint of the new wall will encroach on the stream channel by about 7 to 8 feet. This option
was preferred by Army Corp. The City has submitted an NRPA permit application for the gabion wall proposal to DEP.
The proposal from Lou Silver to complete the discussed wall work for a fee of $275,000.00. Staff recommendation is that
this fee is appropriate for this project as the Kenduskeag Stream is tidal and work will have to be completed in short
intervals during low tide. In addition, this type of work is difficult to complete during typical winter weather conditions.
The City of Bangor has been budgeting money for a future project to address the Kenduskeag Stream retaining walls,
however we did not anticipate this wall failure so soon. The City has about $200,000 currently dedicated to the
Kenduskeag Stream retaining walls which is not enough to cover the Contractors fees for this work. However, savings
realized on the replacement of the Willard C. Orr pedestrian bridge are sufficient to cover the balance of the project costs.

Be it Ordered by the City Council of the City of Bangor that, the City is hereby authorized to execute a
contract with Lou Silver Construction Company in the amount of $275,000 for emergency repair of a portion
of the Kenduskeag Stream retaining wall.
