Authorizing the Execution of a Memorandum of Understanding regarding ICAC Investigations with the State
Police
This Order would authorize the City Manager to execute a Memorandum of Understanding ("MOU")
regarding ICAC investigations with the State Police. The MOU would provide appropriate protocols for
investigating such cases.
"ICAC" stands for Internet Crimes Against Children, and these crimes often involve the sexual exploitation of
children. Many ICAC cases originate by report of internet service providers, including search engines like
Google or Bing, who are mandated to report certain suspicious activity. Such internet service provider
reports are sent to a national ICAC Task Force who then refers the report to the State from where the
activity originated. In Maine, these reports get sent to the State Police Computer Crimes Unit.
For years, the State Police have sent any reports originating in Bangor to the Bangor Police Department and
allowed the Bangor Police Department to investigate those reports. The national level ICAC Task Force has
objected to this practice but would consent to it if there is an MOU in place between the Bangor Police
Department and the State Police.
The potential detriments of the MOU are that the City is binding itself to investigate ICAC cases in a specific
manner and agreeing to litigate any dispute in Augusta. The benefits of the MOU are that the Bangor Police
Department will be allowed to continue investigation ICAC cases, that the State police may assist with
training or funding for training, and that the Bangor Police Department will have access to peer review and
other ICAC resources.

Authorizing the Execution of a Memorandum of Understanding regarding ICAC Investigations with the State
Police
WHEREAS, the State Police have requested that the Bangor Police Department enter into a Memorandum of
Understanding ("MOU") regarding the investigation of Internet Crimes Against Children ("ICAC"),
WHEREAS, executing such MOU may be necessary for the State Police to continue referring ICAC cases
originating in Bangor to the Bangor Police Department,
WHEREAS, the Bangor Police Department desires to continue investigating such cases, and
WHEREAS, the greater good of the citizenry of Bangor will be served by the Bangor Police Department so
continuing to investigate those ICAC cases,
Be it Ordered by the City Council of the City of Bangor that, the City Manager is authorized to execute a
memorandum of understanding with the State Police where that memorandum of understanding relates to the
appropriate protocols for investigating cases involving internet crimes against children. Such memorandum of
understanding will be in a final form approved by the City Solicitor or Assistant City Solicitor.
