This Order authorizes a 5th amendment to the lease between the City of Bangor and the Maine Army National Guard to include the heliport at Bangor International Airport. The Army Guard is the sole user of this heliport, which is in dire need of repair. The Maine Army National Guard and the City propose to amend the existing lease to include this area which provides the Army Guard with a long term interest in the property so this area will be eligible for Federal funding through the military construction funding program. In all other respects, the terms and conditions of the lease and prior amendments between the Parties remains in full force and effect. This amendment will be in final form as approved by City Legal. Consent 12/14/202021-035 CITY OF BANGOR ORDER 12/14/2020 21-035 Davitt Authorizing the City Manager to Execute a 5th Amendment to the Lease Between the City of Bangor and the Maine Army National Guard to Include the Heliport at Bangor International Airport. WHEREAS, the Lessor is the owner of an Airport, commonly known as “Bangor International Airport”, formerly known as Dow Air Force Base and located in the City of Bangor, County of Penobscot, State of Maine ( hereinafter sometimes referred to as the “Airport”); and WHEREAS, the Maine Army National Guard has several facilities adjacent to the airport and leases some airport property for its use; and WHEREAS, the Army National Guard would like to make improvements to the heliport located at the airport; and WHEREAS, the Army National Guard must retain an interest in the property in order to use Federal funds for repairs of this area; and WHEREAS, it would be beneficial to both parties to have this amendment. NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR, That Catherine M. Conlow, City Manager, is hereby authorized on behalf of the City of Bangor to execute a 5th amendment to the lease agreement with the Maine Army National Guard to include this heliport. In all other respects, the terms and conditions of the agreement, and prior amendments between the Parties remain in full force and effect. This amendment will be in final form as approved by City Legal.
