HomeMy WebLinkAbout2020-12-14 21-043 Order 12/14/202021-043 12/14/2020 21-043 Legal Order 041-107 Title, Order Authorizing the Execution of a Development Agreement and a Municipal Quitclaim Deed for 72 Center Street This Order would authorize the City Manager to execute a development agreement and quitclaim deed for the property at 72 Center Street. The City has an ownership interest in the 72 Center Street property by way of matured real estate tax, sewer, and stormwater liens. The building is vacant and placarded. A potential buyer, Bruce Hamel, reached out to the City in late November to determine what work needed to be done to remove the building from the placard list. Mr. Hamel was informed of the City's liens and the development agreement process. Mr. Hamel agreed to enter into a development agreement to restore the property, and he has already tendered payment of the amounts due to the City. Said development agreement shall be in a final form as approved by the City Solicitor or Assistant City Solicitor and contain at least the following conditions: - That the property be redeveloped as a multifamily home, - That the property be brought up to applicable building and life safety code conditions, - That the developer obtain all necessary permits by June 1, 2021 and complete the redevelopment within one year of pulling said permits, - That the City be paid all amounts due on the property before any Quitclaim Deed is issued, and - That taxes or a payment in pieu of taxes (PILOT) always be paid upon the property. Finance Committee 12/07/2020 Recommend for passage 50 Consent 12/14/202021-043 CITY OF BANGOR ORDER 12/14/2020 21-043 Okafor Authorizing the Execution of a Development Agreement and a Municipal Quitclaim Deed for 72 Center Street WHEREAS, City has an ownership interest in the property located at 72 Center Street by way of matured real estate tax, sewer, and/or stormwater liens, WHEREAS, Mr. Bruce Hamel has tendered payment of all amounts due to the City and has indicated his willingness to enter into a development agreement with the City, and WHEREAS, under any development agreement, Mr. Hamel will be required to restore the property such that it meets applicable building and life-safety codes, Be it Ordered by the City Council of the City of Bangor that, the City Manager is hereby authorized to execute a development agreement with Bruce Hamel for the rehabilitation of 72 Center Street. Said Development Agreement shall contain terms and conditions necessary to ensure that that Property is brought into compliance with building and safety codes and is rehabilitated as a multifamily home. Said Development Agreement shall contain conditions that the developer must obtain all necessary permits by June 1, 2021 and complete the redevelopment within one year of pulling said permits, that the City be paid all amounts due on the property before any Quitclaim Deed is issued, and that taxes or a payment in lieu of taxes (PILOT) always be paid upon the property. The Development agreement shall contain a reverter clause that may be exercised in the event that the rehabilitation is not completed as agreed. The City Manager is further authorized to execute a Municipal Quitclaim Deed for the Property releasing the City's interest to Bruce Hamel. Said Deed shall contain a reverter provision as mentioned above. Said Development Agreement and Deed shall be in a final form as approved by the City Solicitor or Assistant City Solicitor.
