HomeMy WebLinkAbout2020-11-23 21-034 Order 11/23/202021-034 11/23/2020 21-034 Legal Order 039-189 Title, Order Authorizing the Execution of a Development Agreement and a Municipal Quitclaim Deed for 57 Division Street This order will authorize the City Manager to enter into a Development Agreement with Brenda Farmer for redevelopment of 57 Division Street. A deed with reverter provisions will also be issued as part of that Development Agreement. Currently, the City of Bangor has an ownership interest in 57 Division Street ("the Property") by way of a matured tax lien. The Finance Committee discussed disposition of the property at four separate Finance Committee meetings that occurred on September 21st, October 5th, October 19th, and November 12th of this year. At those meetings, the Finance Committee discussed what to do with the City's interest in the property. Because the property is vacant, placarded, and in disrepair, the Finance Committee initially voted to recommend taking formal possession of the Property. However, after hearing from the prior owners, (Rebecca and Bruce Wyman) about their extenuating circumstances with the property, the Finance Committee voted to release the City's interest upon a sale of the property if the future buyer was willing to enter into a Development Agreement with the City. The Wyman's now have an agreement in place for the sale of the property to Brenda Farmer of Hudson, Maine. If approved, the development of the property will be performed by Rachel Ortiz and Lenin Ortiz, who are relatives of Ms. Farmer. The Development Agreement and Deed will be in a final form approved by the City's Legal Department. Finance Committee 10/19/2020 Recommend for passage 50 The Finance Committee voted to recommend to Council that the City release its interest in 57 Division Street upon a sale of the property to a buyer willing to rehabilitate the property and enter into a Development Agreement with the City. It did not specifically review the identity of the buyer. New Business 11/23/202021-034 CITY OF BANGOR ORDER 11/23/2020 21-034 Hawes Authorizing the Execution of a Development Agreement and a Municipal Quitclaim Deed for 57 Division Street WHEREAS, the City of Bangor has an ownership interest in 57 Division Street ("the Property") by way of a matured tax lien; WHEREAS, the Property is vacant, placarded, and not in compliance with City Code; WHEREAS, the assessed taxpayers have an agreement to sell the Property to Ms. Brenda Farmer of Hudson, Maine; WHEREAS, the City is willing to release it's ownership interest in 57 Division Street with agreements in place ensuring that the property will be brought up to code standards; and WHEREAS, Ms. Farmer is willing to bring the property up to code standards, enter into agreements with the City, and generally rehabilitate the Property as a single-family home; Be it Ordered by the City Council of the City of Bangor that Catherine M. Conlow, City Manager, is hereby authorized to execute a Development Agreement with Brenda Farmer for the rehabilitation of the property located at 57 Division Street. Said Development Agreement shall contain terms and conditions necessary to ensure that that Property is brought into compliance with building and safety codes and is rehabilitated as a single-family home. Said Development Agreement shall also contain provisions that include a time frame for beginning and completing work, that taxes will always be paid upon the property, and a reverter clause in the event that the rehabilitation is not completed as agreed. The City Manager is further authorized to execute a Municipal Quitclaim Deed for the Property releasing the City's interest to Ms. Brenda Farmer. Said Deed shall contain a reverter provision as mentioned above. Said Development Agreement and Deed shall be in a final form as approved by the City Solicitor or Assistant City Solicitor.
