HomeMy WebLinkAbout2020-11-09 21-011 Order 11/09/202021-011 11/09/2020 21-011 Airport Order 001-001 Title, Order Authorizing the City Manager to Execute a 1st Amendment to the Lease Agreement Between the City of Bangor and WNC Bangor Company LLC. This Order authorizes a 1st amendment to the lease between the City of Bangor and WNC Bangor Company LLC. WNC currently leases land and operates certain hotel premises at the airport known as the Four Points by Sheraton. WNC is currently entering year 2 of a 20 year lease term. This company is experiencing significant financial impacts due to the COVID-19 pandemic. Through this amendment, the Parties mutually agree of a suspension of the annual ground rent totaling $84,000 for 2020. WNC shall repay the $84,000 in equal monthly installments of $1,750 per month for 48 months beginning in July 2021. In all other respects, the lease between the parties remains in full force and effect. This lease amendment will be in final form as approved by City Legal. Consent 11/09/202021-011 CITY OF BANGOR ORDER 11/09/2020 21-011 Hawes Authorizing the City Manager to Execute a 1st Amendment to the Lease Agreement Between the City of Bangor and WNC Bangor Company LLC. WHEREAS, the Lessor is the owner of an Airport, commonly known as “Bangor International Airport”, formerly known as Dow Air Force Base and located in the City of Bangor, County of Penobscot, State of Maine (hereinafter sometimes referred to as the “Lessor or Airport”); and WHEREAS, WNC Bangor Company LLC. currently holds and operates certain premises at Bangor International Airport known as the Four Points by Sheraton (the “Hotel or Lessee”) under provisions of certain agreement of lease dated November 6, 2019; and WHEREAS, WNC Bangor Company LLC. is experiencing significant financial impacts due to the COVID-19 pandemic; and WHEREAS, WNC Bangor Company LLC. desires to make an adjustment to the payment of rent for the year of 2020. NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR, That Catherine M. Conlow, City Manager, is hereby authorized on behalf of the City of Bangor to execute a 1st amendment to the Indenture of Lease of November 6, 2019 between the City of Bangor and WNC Bangor Company LLC. The amendment shall include changes to Article III of the Lease whereby the Parties mutually agree of a suspension of the annual ground rent totaling $84,000 for 2020. WNC Bangor Company LLC. shall repay the $84,000 in equal monthly installments of $1,750 per month for 48 months beginning in July 2021. This lease amendment will be in final form as approved by City Legal.
