Authorizing the removal of conditions set forth in a Quitclaim of the City of Bangor to George Miller III for the
Single Family Home Located at 44 Sixteenth Street.
This Order would authorize the City Manager to execute a Deed to George Miller III for property
located at 44 Sixteenth Street, acknowledging satisfaction of the development conditions including
the issuance of a certificate of occupancy through Code Enforcement.
Council Order 19-289, dated July 22, 2019, authorized the City Manager to take possession of the
property located at 44 Sixteenth Street ("the Property"), by way of a 2017 matured tax lien. Council
Order 20-044, dated December 23, 2019, authorized the sale of the property to George Miller III
with certain conditions. Specifically, the conditions required that Mr. Miller spend at least $15,000
on the rehabilitation of the property (as a single family home), obtain building permits for that
rehabilitation on or before February 1, 2020, and complete the rehabilitation and obtain a certificate
of occupancy within one year of obtaining said building permits. These conditions also included, for
enforcement purposes, a reverter provision that favored the City of Bangor.
George Miller III has now requested that the City release the development and reverter conditions.
Mr. Miller has spent over $60,000 in rehabilitation costs, final inspections have been completed, and
a certificate of occupancy has been issued.

Authorizing the removal of conditions set forth in a Quitclaim of the City of Bangor to George Miller III for the
Single Family Home Located at 44 Sixteenth Street.
WHEREAS, the City authorized the sale of the property located at 44 Sixteenth Street ("the Property") to
George Miller III;
WHEREAS, the City required and Mr. Miller agreed to certain development conditions within the deed,
including a reverter provision;
WHEREAS, Mr. Miller has requested the release of the development conditions and reverter provision in the
City's original deed to him;
WHEREAS, rehabilitation of the property is complete, the conditions of development have been met, and a
certificate of occupancy for the Property has been issued;
BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR, THAT
The City Manager is hereby authorized, on behalf of the City of Bangor, to execute a deed and any other
documents necessary to release the reverter clause and the following conditions described in the Quitclaim
Deed to George Miller III that is recorded in the Penobscot Registry of Deeds, Book 15406, Page 12:
1. That the developer shall spend a minimum of $15,000 on the rehabilitation of the single family home.
2. That the developer shall obtain a building permit on or before February 1, 2020.
3. That the developer shall complete the project and obtain a certificate of occupancy within one year of
obtaining said building permit.
The final deed and other necessary documentation will be in a form approved by the City Solicitor's Office.
