Summary
This ordinance amendment would change the zoning on a parcel of land addressed at 82 Second Street from
Urban Residence 2 (URD -2) to Multi -Family and Service District (M&SD).
The applicant, Jordan Bailey wishes to place a four-plex on the property. The comprehensive plan identifies
the property as URD -2 and the entire neighborhood is URD -2. Under URD -2 the applicant is permitted to
build a four -unit building, however, the lot coverage ratio is less under M&SD.
The lot is 2 blocks from Main Street and the waterfront, a few lots away from Second Street Park, and is
convenient to the core business district by walking. A bus line is nearby. The neighborhood lots contain
mostly single and two family dwellings.

ORDINANCE, Amending Chapter 165, Land Development Code, District Map by Changing the Parcel of Land
addressed at 82 Second Street, Map 35 Lot 165, from Urban Residence 2 (URD -2) to Multi -Family and Service
District (M&SD).
WHEREAS, at present, the area contains multi -family residences and is conveniently located to goods &
services;
WHEREAS, there are lots in the vicinity that are zone Multifamily and Service District;
WHEREAS, where the City Council has specific goals to encourage affordable housing and multi -family
housing where appropriate;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
Chapter 165 of the Code of the City of Bangor is amended as follows:
The Zoning District Map is hereby changed by changing the parcel addressed at 82 Second Street and as
shown on Map 35 Lot 165 from Urban Residence 2 (URD -2) to Multi -Family and Service District (M&SD).

Please accept this memorandum as the recommendation from the Planning Board for the noted item.
The Planning Board considered this item in a noticed public hearing on October 20, 2020.
The meeting was conducted using the city's Zoom account.
The applicant, Jordan Bailey, reviewed the application. He would like to add an additional unit to the
property as well as use available square footage in the existing structure. Though a 3 family is
allowed in URD -2, he is unable to add the unit or use existing square footage in URD -2 because of
the requirements for area per dwelling unit. The multifamily zone would bring the lot into
conformity.
Concerns were raised about the allowed intensity of the multi -family zone compared to the URD -2
zone. The Board was compelled, however, but the level of non -conformity that is present in the
neighborhood.
Planning Officer Krieg reviewed the staff report. Her comments included:
Both URD -2 and M&S are multifamily districts. The difference between the 2 districts is primarily that
the amount of the lot that can be developed is more intense in the multi -family district. This lot
already has 2 units according to assessing records. The lot is currently developed in keeping with
and similar to the lots in its environs.
The Comprehensive Plan has the area as URD -2. There was staff concern that this zoning change
will provide the opportunity to develop this site in a manner that is not in keeping with the
neighborhood.

Additionally, staff is working on reducing lot sizes in the residential zones, which will bring a large
number of lots in this neighborhood into conformity.
In response, the Board was compelled by the nonconformity of the lot, as well as the proposed
development of the property as stated by the current owner.
The Board passed a motion, by roll call, made by Member Shaw and Seconded by Member Meagher,
to recommend to the City Council that the said zoning district change ought to pass. All members
voted yes.
