HomeMy WebLinkAbout2020-08-10 20-257 Order 08/10/202020-257 08/10/2020 20-257 Airport Order 001-001 Title, Order Authorizing Execution of Lease Agreement Amendments with C&L Aerospace Holdings, LLC This Order will authorize the City Manager to execute amendments to three separate leases between the City of Bangor and C & L Aerospace (C & L) that will require C & L, on a one-time basis, to paint the leased hangars. Under the terms of the existing leases, the City of Bangor is responsible maintaining the exterior portions of the leased hangars. Under the proposed amendments, C & L agrees to paint the hangers at a 50/50 cost share with the airport. The total amount cost to the airport will not to exceed $55,000. Additionally, the City will pay C& L over a five-month period by reducing the rent obligations of C & L. Earlier estimates obtained by Airport staff had the project cost at $125,000. Under this agreement, the City saves money and C & L is able to use existing paint staff to complete the project. The Airport had previously identified painting of those hangar exteriors as a desired future capital improvement related to upkeep and maintenance. These amendments shall be in final form as approved by City Legal. Airport Committee 08/03/2020 Recommend for passage 50 Staff recommends approval. New Business 08/10/202020-257 CITY OF BANGOR ORDER 08/10/2020 20-257 Tremble Authorizing Execution of Lease Agreement Amendments with C&L Aerospace Holdings, LLC WHEREAS, the City is the owner of an Airport, commonly known as “Bangor International Airport”, formerly known as Dow Air Force Base and located in the City of Bangor, County of Penobscot, State of Maine (hereinafter sometimes referred to as the “Airport”); and WHEREAS, the City of Bangor and C&L Aerospace Holdings, LLC are Parties to three Indentures of Lease dated May 01, 2014, October 6, 2014, and June 22, 2016, wherein C & L Aerospace Holdings, LLC leases certain airport facilities, also known as Hangars 10, 11, 12, and 13 from the City of Bangor; and WHEREAS, per the lease agreements, the City is responsible for maintaining and repairing all structural and operating systems for the hangars; and WHEREAS, the airport identified painting of the hangar exteriors as a future capital improvement for upkeep and maintenance; and WHEREAS, C&L employs professional aircraft painters and desires to perform such exterior painting of the hangars and cost share the expense with the City. NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR, That Catherine M. Conlow, City Manager, is hereby authorized on behalf of the City of Bangor to execute a first amendment to the lease between the the City of Bangor and C&L Aerospace for painting the exterior of Hangars 10, 11, 12 and 13 at the airport. C & L shall be responsible for all costs, including labor, paint, materials and equipment, but the City will cost-share, on an equal basis, the labor, paint, and materials with C & L. The City's cost-share, however, shall not exceed $55,000.00 total. The City will reimburse C & L for its portion of the costs through lease payment reductions. These amendments shall be in a final form as approved by City Legal.
