RESOLVED, WHEREAS, Executive order 11025 requites that Federal

WIEREAS, the Department of Transportation has adopted a policy to

program and has instituted its own procedures to ensure use of minority

OF THE

INTRODUCTION
This Minority Business Enterprise Program is submitted by the City
of Bangor in compliance with the requirements of 49 CFR Par[ 23.
Upon the receipt of further guidance from the Federal Government
on the preparation of MBE Programs, this program will be reviewed and
necessary changes submitted for approval.
Bangor International Almon is a small Hub Airport which is seeking an
Airport Development Ald Program Grant exceeding $500,000. Therefore
the Airport is classified as Group III In respect to the requirements for
a Minority Business Enterprise Program.
The major requirements of the Program are the following:

The purpose of this program is to promote full participation of Minority
Business Enterprises in Federally funded business undertakings of the
City of Bangor Airport Department.
it reflects our obligation to make a maximum reasonable effort to assure
that the businesses and the services of the minority communities around
us have an equal opportunity to compete as sources of services and supplies.
Outlined in the following pages is the framework for the actions which
will give effect to our commitment.

The City of Bangor's policy towards Minority Business Enterprises
is a commitment to give minority business the opportunity to
compete with all other businesses on an equal basis.
The commitment to utilize Minority Business Enterprises to the maximum
extent practicable shall include, but not be limited to, vendor supplied
goods, financial commitments, construction activities, freight for-
warding and outside profs a sional service a.
It 1s the policy of the City of Bangor Airport Department to utilize
Minority Business Enterprise In all Federally funded aspects of
contracting. This commitment can be demonstrated by the efforts
taken In the development of this plan and in correspondence within this
organization stating such position.
All of the assurances as described In 49 CFR Part 23.43 will be included
in effected Invitations for Bids and will be included in all resulting
contracts.
Whenever possible the City of Bangor shall not exclude MBEs from
participation in business opportunities by entering into long term,
exclusive agreements with non -MBEs for the operation of majortrans-
portetlon related activities or major activities for the provision of
goods and services to Bangor International Airport or to the public on
the airport. All lessees must avoid discrimination and all future contracts
with lessees shall contain the appropriate non-discrimination sections
If they are not already contained in the Contract.

LEASING GOALS (Airport Department)
The City of Bangor Airport Department has presently eighteen (18)
leases of which one (1) is a Minority BusinessEnterprise.
The level of revenues changes considerably depending upon the
number of unscheduled offline and supplemental air carrier charters
which significantly impacts leasing goals.
Therefore a percentage goal based on actual number of leases will be
utilized.

By the City Council of the City of Bangor:
RESOLVED, WHEREAS, Executive Order 11025 requires that Federal
executive agencies develop comprehensive plans and programs to encourage
minority business, enterprises; and
WHEREAS, the Department of Transportation has adopted a policy to
encourage and increase participation, has published a final rule (49 CFR
Part 23; 45 FR 21112) creating a minority business enterprise program; and
WHEREAS, the City Council of the City of Bangor fully supports such a
program and has instituted Its own procedures to ensure use of minority
business enterprises at Bangor International Airport,
NOW, THEREFORE, by the City Council of the City of Bangor:
RESOLVED THAT it is the policy of the City Council of the City of
Bangor to not discriminate on the basis of race, religion, creed, color,
national origin, or sex in the procurement of goads and services at Bangor
International Airport, and be it further
RESOLVED THAT it is the policy of the City Council of the City of
Bangor to afford minority business enterprises the maximum opportunity to
compete for and perform contracts and subcontracts and provide materials, and
to promote the development and expansion of minority business enterprises by
taking all necessary and reasonable steps to encourage such participation at
Bangor International Airport, and be It further

Officer for purposes of the minority business enterprise program and is
hereby authorized and directed to take all necessary action for purposes
of Implementing and administering said prcgram.
The foregoing is a true copy of a resolve adopted by the Bangor City
Council at a special meeting Wednesday, August 21, 1980.

II. LIAISON OFFICER AND SUPPORT STAFF
A. Deslanation
The Bangor City Council has designated the City Manager, Into Flynn
or his successors, as the MBE Liaison Officer. The MBE Liaison
Officer will report directly to the City Council on all matters concerning
this MBE Program.
A support staff, appointed by the City Manager, shall include such
staff as may be required to adequately administer the program. The MBE
Liaison Officer shall periodically review support staffing requirements
and make appropriate recommendations regarding these requirements to
the City Council or such of Its Committees as may be appropriate.
B. Responsibilities
The MBE Lialson Officer shall have full responsibility for the proper
implementation and management of the City of Bangor Minority Business
Enterprise Program. He shall review and recommend changes to the
program as required, and will periodically report on the progress of the
program.
He or his staff shall provide technical assistance to MBEs as required,
desseminaate information on available business opportunities, compile
and make necessary revisions to the MBE directory, ascertain the
eligibility of MBEs, maintain records, monitor contractor MBE programs,
and perform all other duties necessary for proper administration of this
program.
III. ENSURING EQUITABLE COMPETITION FOR CONTRACTS AND !�
SUBCONTRACTS BY MBES
The City Purchasing Agent, acting under, the direction of the MBE
liaison Officer, shall develop and use affirmative action techniques to
facilitate MBE participation In contracting activities including:
A. Appropriately arranging solicitation and time for
presentation of bids. -

B. Providing technical assistance to MBE's to overcome
barriers such as the inability to obtain beading and/or
financing.
C. Carrying out information and communication programs on
contracting Procedures and specific contracting opportunities
in a timely manner.
D. Thoroughly investigating the full extent of services of banks
owned and controlled by minorities or women.
E. Making available MBE directory, which specifies which
firms are eligible MBE's to bidders and proposers in their
efforts to meet MBE requirements.
N. MBE DMECTORY
The MBE liaison Officer and the support staff will update and expand its
present MBE directory to include the following information:
A. Names, address, and telephone numbers. -
B. Type of MBE (minority or female).
C. Date of business was established.
D. Legal structure. of business.
E. Percent minority/female ownership.
F. Capacity.
G. Previous work experience.
H. forcing capability.
1. Type of work/service provided.
J. Contact persons.
K. Date of listing entry and source of data
MINORITY BUSINESS ENTERPRISE PROGRAM (Continued)
The directory will be categorized by types of firms listed, and will
be made available to all bidders and proposers to assist them in their
efforts to meet MBE requirements.
The directory will be compiled from Bangor Purchasing Department
sources, Small Business Administration, the National Minority
Supplier Development Council MBE Data Branch, and MEE directories.
MBEs will be solicited in metropolitan and minority newspapers if
available.
The MBE directory is scheduled for completion by January 1, 1981. It
will be revised and updated annually or as required. The preliminary
MBE Directory included at the end of this program was obtained from
Ms. Lilian Baker, the State of Maine's Department of Transportation Y�
Liaison Officer. Therefore, the City of Bangor does not certify the
preliminary directory as being complete or accurate. MBE's will be
certified on a case by case basis until the directory is complete.
V. ELIGIBILITY OF MINORITY BUSINESS ENTERPRISES (ALSO SEE
CERTIFICATION SECTION
Schedule A for Minority Business Firms and Schedule B for pdnt�-s
Nantire _contained before -]will be utilized to determine eligibility
of firms. Pending approval of the use of these forms, a "conditional"
certification based on a certification from the Minority Business Enterprise
itself will be utilized. The "Conditional" Certification Includes other
Department of Transportation Certification, other equivalent federal
certification or SBA 8(A) Certification. Eligibility is based upon the
standards as set forth In 49 CFR 23.53.
Prime contractors shall be required to make good faith efforts to replace
an MBE subcontractor that is unable to perform successfully with another
MBE.
VI. DEVELOPMENT OF PERCENTAGE GOALS FOR MBE PARTICIPATION
A. Overall Goals
Overall goals shall be established annually. Separate goals shall be
established gbcgboth women and minority owned and controlled firms.
Factors to be considered in the establishment of these goals shall be
minority population in the general area, number and types of contracts
to be awarded and availability of MBEs to provide the necessary services,
_ and past results of connecting efforts with MBEs.

Of necessity, in establishing an overall goal for participation of
women -owned and controlled firms, the availability of these firms to
provide the necessary services will be the most important factor.
These goals will be established upon evaluation of limited data
presently available, certification of MBEs, and receipt of additional
guidelines from the Federal Government.
The overall goals for minority owned businesses is 2% and for woman -
owned businesses is .5%.
B. Contract Goals
As required Invitation for Bids and project specifications for projects
shall contain MBE utilization goals as described in this section.
The MBE support staff and the MBE Liaison Officer shall develop contract
goals from evaluation of MBE resources gathered from the MBE directory
and other community sources. In establishing an MBE contract goal,
the support staff shall identify portions of the procurement or contract
which MBE firms feasibly could supply or perform on a comeptitive basis.
Separate contract goals will be established for participation by both
minority and female owned and controlled firms.
The City of Bangor shall require contractors to seek, at a minimum,
MBEs in the same geographic area in which they seeksubcontractors
generally for a given solicitation. If a contractor cannot meet the
goals using MBEs from this geographic area, as a part of its efforts
to meet efforts to meet the goal, It shall expand its search to a reasonable
wider geographic area. _

MINORITY BUSINESS ENTERPRISE GOALS
The City of Bangor has established overall goals for the participation
of Minority Business Enterprises in its Federally assisted Airport.
Department contracts. The goal for minority owned and controlled
businesses is 2 percent. The goal for women -owned and controlled
businesses is .5 percent.
These goals and a description of how they were selected are available
for inspection for 30 days during normal business hours (8-4:30 Monday -
Friday) at the Bangor Purchasing Agents Office, City Hall, Harlow Street,
Bangor, Maine 04401.
The Bangor City Council will accept written comments on the goals ant
the methodology of their selection. Comments are for informational
purposes only. Comments should be addressed to Mr. Ieroy E. Donnelly,
CPPO, CPM, Purchasing Agent, City of Bangor, City Hall, Harlow Street,
Bangor, Maine 04401.

VII. IDENTIFICATION OF USES BY COMPETITORS
In solicitations that provide opportunities for MBE participation, the
City Purchasing Agent, MBE liaison Officer or his staff shall establish
goals for MBE participation. Solicitations shall require all bidders or
proposers to submit written assurance of meeting the goals in their
bids of proposals.
All bidders will be required to submit the following information with
their bids;
A. Names of MBE subcontractors,
B. A description of the work each MBE subcontractor is
to perform, -
C. The dollar value of each proposed MBE subcontractor,
D. Schedules A or B as applicable.
Bidders andproposers will be informed of this requirement in the
solicitation.
Bidders/proposers will be prohibited from entering into agreements
with an MBE in which the MBE promises not to provide subcontracting
quotations to other bidders/proposers. An excerpt from aqyplgdl'j
Invitation for Bid is included as part of this program (see page 12).

To meet the requirements of *Department of Transportation Regulation,
Part 23, all bidders will provide evidence of the methods they have used
to meet the Minority Business Enterprise/joint Venture goals as published
In the Sponsor's Minority Business Enterprise Plan and approved by the
Federal Government. The MBE participation goal for this project is _%.

VIII. SELECTION CRITERIA USED TO ENSURE THAT PRIM CONTRACTS
ARE GRANTED TO COMPETITORS THAT MEET MINORITY BUSINESS
ENTERPRISE GOALS
If any competitor offering a reasonable price meets the ME
contract goal, the recipient shall presume conclusively
that all competitors that failed to meet the goal have
failed to exert sufficient reasonable efforts and con-
squently are ineligible to be awarded the contract.
To implement this presumption, the receipient shall deter-
mine whether the competitor offering the lowest price of
firma meeting the MBE contract goal has offered a reason-
able price for the contract. If the recipient determines
that this competitor has offered a reasonable price, the
recipient shall award the contract to the firm. I£ the
recipient determines that this competitor's price is not
reasonable, it shall consider next the price offered by the
competitor with the highest percentage of MBE participa-
tion of those firms that failed to meet the goal. If the
recipient determines that this price is reasonable, it
shall award the contract to this competitor. If the
recipient determines that this price is not reasonable,
the recipient shall consider the other competitors that
failed to meet the goal in order of their percentage of
MBE participation until it selects one with a reasonable
price. If the recipient determines that no competitor
with MBE participation has offered a reasonable price, the
recipient may award the contract to any competitor that
demonstrates that it has made sufficient reasonable efforts
to meet the MBE contract.goal.
To decide whether a price offered by a competitor is reason-
able, the recipient shall use the same criteria that it
would use to determine whether;, if the competitor had made
the only offer to perform the contract, the recipient would
award the contract.
To demonstrate sufficient reasonable efforts to meet the
MBE contract goal, a contractor shall document the steps
it hastaken to obtain MBE participation as outlined in
49 CFR 23.45, i, 4. The selection criteria is further de-
tailed in 49 CFR 23.45, 1, 1-7.

M. COMPLIANCE WITH MBE REOUMEMENTS
A. Incorporation of MBE Subcontractors into City of Banner
Consumers
The list of MBE subcontractors proposed In the 6ids__lf;��
accepted by the Pirates Committee of the City Council, shall be
incorporated Into the contract with the prime contractor. Should it
I e necessary, subsequent to the award of the contract to substitute
MBE subcontractors, the Purchasing Agent must approve such sub-
stitutions and the overall percentage of MBE utilization within the
project 'shall not be diminshed unless approved by the Purchasing
Agent. Upon entering into zubcontracts'_with MBEs, the successful
bidder will not terminate or reduce the scope of work to be performed
by or decrease the price to be paid to the MBE or joint venture without
prior written approval of the Purchasing Agent.
Prime contractors shall report to the Purchasing Agent as to their
compliance with the MBE program, and shall submit to periodic
announced compliance inspections by the MBE Iiaison Officer or
his staff.
Prime contractor shall assign an equal employment opportunity
coordinator to assure that hisAer supervisors are aware of their
responsibilities pertaining to affirmative action and non-discrimination.
Upon request, prime contractors shall famish to the Purchasing Agent
a copy of the latest Fedaml EEO -1 or equivalent form.
The MBE Liaison Officer shall be kept informed of all significant
administrative activities relating to the ongoing management of the
project.
In the event of a prime contractor's non-compliance with EEO or MBE
requirements of the contract, the Purchasing Agent shall impose such _

limited to the following':
1. Withholding of Payment to the contractor under
the contract until he complies;
2. Cancellation, termination, or suspension of the
contract In whole or in part;
3. Any other available legal remedy

B. Contract Statements
The following statements will be included In all effected City of
Bangor construction contracts; -
(1) "PolldV. It is the policy of the Department of
Transportation that minority business enterprises as
defined in 49 CPR Part 23 shall have the maximum
opportunity to participate in the performance of
contracts finances in whole or in part with Federal
funds under this agreement. Consequently the MBE
requirements of 49 CFR Part 23 apply to this agreement.
(2) "MBE Obligation. The recipient a2 its contractor
agrees to ensure that minority business enterprises as
defined in 49 CFR Part 23 have the maximum opportunity
to participate in the pgHormance of contracts am sub-
contracts financed in whole or in part with Federal
fonds provided under this agreement. In this regard all
recipients or contractors shall take all necessary and
reasonable steps in accordance with 49 CFR Part 23 to
ensure that minority business enterprises have the
maximum opportunity to compete for and perform contracts.
Recipients and their contractors shall not discriminate on
the basis of race, color, national origin, or sex in the
award and performance of DOT -assisted contracts."
X. MBE BET -ASIDE PROGRAM
A. Conditions of Implementation
If necessary to meet overall MBE goals, an MBE set-aside program
may be implemented. MBE set -asides would be used only In cases
where at least three MBEs with capabilities consistent with contract
requirements exist so as to permit competition.
B. Development of Set -Aside Projects/Contracts
If necessary to implement an MBE set-aside program, a list of projects
and/or contracts for goods and services for set-aside purposes shall be
developed by the MBE Liaison Officer and support staff after review and
analysis of all City of Bangor programs. Contract and bidding procedures
will be in accordance with applicable sections of this program and City
of Bangor Purchasing Regulations.

In order to monitor the progress of its MBE program the MBE Liaison
Officer or his staff shall develop a record-keeping system which will
identify and assess MBE contract awards, prime contractors' progress
In achieving MBE subcontract goals, and other MBE affirmative action
efforts.
Specifically, the MBE l5alson Officer or his staff shall maintain records
showing:
(1) Procedures which have been adopted to comply with the
requirements of this part.
(2) Awards to MBEs. These awards shall be measured against
protected MBE awards and/or MBE goals. To assist in this
effort, the Purchasing Agent shall obtain regular reports
from contractors on their progress In meeting contractual
MBE obligations.
(3) Specific efforts to identify and award contracts to MBEs.
Records shall be available upon the request of an authorised officer or
employee of the Federal Government.
The MBE liaison Officer or his staff shall submit reports quarterly and
these reports shall include as a minimum:
(1) The number of contracts awarded to MBEs;
(2) A description of the general categories of contracts
awarded to MBEs;
(3) The dollar value of contracts awarded to MBEs;
(4) The percentage of the dollar value of all contracts
awarded during this period which were awarded to
MBEs; and
(5) An indication of whether and the extent of which the
percentage met or exceeded the goal specified in the
application.
The records and reports required by this section shall provide information
relating to firms owned and controlled by minorities separately from
information relating to firms owned and controlled by women. If the records.
add reports include anycontractorsdefined under section S(a) of the
Small Business Act, as amended, that are not minorities or woman,
Information concerning these contractors shall also be recorded and reported
separately.

MINORITY BUSINESS ENTERPRISE CERTTFICATION
To ensure that this program benefits only MBEs which are owned and
controlled in both form and substance by one or more minorities or
women. The City of Bangor shall use Schedules A and B (reproduced
at the end of this Section) to certify firms who wish to participate as
MBEs.
Except as provided in paragraph (a) of this section, each business,
including the MBE partner in a joint venture wishing to participate
as a MBE in a Federally assisted Airport Department contract shall
complete and submit Schedule A. Each entity wishing to participate
as a joint venture MBE under this part In Federally assisted contracts
shall in addition complete and submit Schedule B. The schedule (s)
shall be signed and notarized by the authorized representative of the
business entity. A,business seeking certification as an MBE shall
submit the required schedules with its bid or proposal.
(a) Under the following circumstances, a business seeking
to participate as an MBE under this subpart need not
submit Schedule A or B.
(1) If a DOT recipient has established a different
certification process that DOT has determined
to be as or more effective than the process
provided for by this section. Where such a
process exists, potential MBE contractors shall
submit the information required by the City of
Bangor process.
(2) rf the potential MBE commotor states in writing
that it has submitted the same Information to or
has been certified by the DOT recipient involved,
any DOT element, or another Federal agency that
uses essentially the same definition and ownership
and control criteria as DOT. The potential MBE
contractor shall obtain the information and
certification (if any) from the other agency and
submit it to the City of Bangor Purchasing Agent
r cause the other agency to submit it. The recipient
may rely upon such a certification. Where another
agency has collected information but net made a

determination concerning eligibility, the City
Purchasing Agent shall make his own determin-
ation based on the information he has obtained
from the other agency.
(3) If the potential MBE contractor has been determined
by the Small Business Administration to be owned
and controlled by socially and economically dis-
advantaged Individuals under section 8(a) of the
Small Business AM, as amended.
Appeals for denial of certification shall be in accordance with 99 CFA
23.55.
