ORDERED, THAT WHEREAS, on September 24, 1979, the Bangor City Council designated Brountas Realty Company of 152 Main Street, Bangor, Maine (hereinafter "DEVELOPER") as the tentative developer of the former Central Fire Station (Renduskeag Stream Urban Renewal Parcel B-3) located at or about 89 Union Street, Bangor, Maine; and WHEREAS, on December 11, 1979, the City of Bangor and the DEVELOPER executed an Option Agreement for the purchase of Said Premises; and WHEREAS, the. Preliminary Plan submitted by the DEVELOPER and approved by the Design Review and Site Plan Review Committee pursuant to Council Order 26 AC 'adopted by the City Council on November 27, 1978 contemplated the acquisition and use of the Hodsdon Street right-of-way; and WHEREAS, by the adoption of Council Resolve No. 58 AN o December 26, 1979, the City Council estab 3shed its intention to dis- continue and abandon Hodsdon Street as a public way between Main Street and Short Street at such time as said DEVELOPER exercised its option to acquire Said Parcel B-3; and - WHEREAS, by virtue of said Resolve No. 58 fit, the City Council established its intention to release unto said DEVELOPER any and all rights that it may have in the Hodsdon Street right-of-way, with the exception of the retention of .existing utility easements and the right ofpublicaccess over said right-of-way to Urban Renewal Parcels B-4 and P-6; and WHEREAS, the acquisition and redevelopment of said premises was r subject to the condition that the City obtain a and all other necessary authority from the United States Department of Housing and Urban Development to permit the DEVELOPER to purchase said premises; and WHEREAS, said waiver was finally granted to the City on July 31, 1980; and WHEREAS, the DEVELOPER exercised its option to purchase on August 6, 1980 pursuant to the terms of the Option Agreement; and WHEREAS, due to the length of time necessary to obtain the Iver certain of the time limits relaxing to the development contem- plated by the Option Agreement are in need of revision; NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT the City Manager is hereby authorized to execute, xc te, on behalf of the City of Bangor, a Purchase and Sale Agreement relative to said premises, a copy of which is on file in the Office of the City Clerk; and BE IT FURTHER ORDERED THAT the City Manager is hereby authorized to take any and all action necessary to accomplish the conveyance of Parcel B-3 and the Hodsdon Street right-of-way (subject to the exceptions and reservations set forth in the aforementioned Council Resolve No. 58 AH) to Brountas .Realty Company, including but not limited to the execution of a Municipal quitclaim Deed in a form satisfactory to the City Solicitor or his representative. t 2]1:H IN ciw cccmcii o R U e R { p3 A9' 'August 25,'1980 Passed by the following yea and�21 no votes.'
