the City of Bangor dated September 23, 1974, as amended be hereby
further amended as follows: .
By changing a parcel of land located at 523 Union Street (Tax Map
No. 20, Parcel No. 34) from Residential 1 Zone to Residential 2 Zone.
Said parcel containing approximately 12,928 sq. ft. and being more
particularly indicated on the map attached hereto and made a part
hereof.

Action for a zoning change will be initiated with they :Cor City Council and
referred to the Bangor Plmning Board. Statutes require a Public Hearing before the
Pluming Board, after a public advertising (at least 10 days prior to each public
hearing), for all changes to the zoning ordinance of the City of Screw. The re-
comendation of the Piercing Board is then returned to the Bangor City Council for
final action. -

I. Highest and Best Use
As a taxpayer attempting to protect my Investment it Is only
reasonable to want to put my property to Its best use. If the
lot at 523 Union Street were vacant what kind of building would
most readily adapt to :the existing neighborhood? Certainly not
a one -family house of that size. These past several years because
of continuous Inflation And the energy situation we have witnessed
many large homes being sold indiscriminately to entrepreneurs
whom only purpose is to convert them to multi -family apartment$.
Other large homes have come to harbor family businesses as an
additional source of Income. Inevitably many homes become victims
of rezoning for much more undesirable usage�thansa^home with s
small apartment. I am trying to prevent this from happening to
that piece of property and the neighborhood.
Over the past two years the market value of my property has
continued to decrease despite considerable Interior and exterior
improvements. F!-w9F o:Lld buy a home of this size as a one -family
dwelling. And those who could afford the maintenance of a home
this size would probably not pureness at that particular location
on Union Street considering the nature of the area. Proper
and adequate upkeep and operation is virtually impossible without
an additional source of income. This past winter I was forced
to close my house and share expenses with a friend at another
location. It requires over 2,000 gallons of heating oil per
year to heat this building. With fuel bills doubling over the
past two years It is no longer practical, or at times feasible.
for one family (let alone one person) to occupy this home.
There are those who scream energy efficiency and conservation
but the same people would allow a two and one-half story, nine -
room house to remain a one -family dwelling. I have done more
than my share to upgrade the appearance of the neighborhood within
my lot but ironically I an being forced to consider selling and
losing on my Investment because of unpredictable circumstances.
II. Conformity
One need only look at a map of the area In question to realize
that over the years this area has evolved into a melting pot of
zoning classifications and/or exceptions to them. Union Street
1s certainly one of the main thoroughfares in Bangor. It Is the
main route to Bangor International Airport and two shopping centers
and provides access to I-95. Union Street is one of only four or
five streets In Bangor on which a homeowner may operate a business
from his home and employ one person outside of the immediate
family. Because of the busy nature of the street and the oppor-
tunity for private business the entire street has attracted a
diversity of businesses. Within the area In question spennlu only
a distance of approximately two blocks we find Grant's Trailer
Park with 85 trailer units and business office, two gas
stations, Merchant's National Bank branch. barber shop. Grant's
Dairy, Church of Christ, and The Television Workshop. Less than
a block away is a four-oorner intersection with a traffic light.
The noise level Is extremely high. On practically every day of
the week one might witness a speeding pollee car. ambulance Or
several fire engines with blaring sirens, often during the early
morning hours. Several of the homes In this neighborhood have
rented previously Including lot E and J (three-family variance).
At lot B adjacent to my property, for longer than anyone can
remember, is a duplex. When I purchased my house two years age
it was occupied by the owner and two people renting rooms on the
second level. At that time it was indicated to me by the realtor
that considering the fact that I an single and it is such a large
house, I might want to tort a portion of It. Items shown where a
separate meter had been previously installed to deliver electricity
to the second level. It was never indicated to me that this was
an R -I area but in fact was suggested otherwise. Obviously these
same people who rent in the area or sold me the property have
to call my request spot zoning should examine more CIO
