Cow Beginning at a point on the northwesterly right-of-way line of Sunset Avenue, as laid out and accepted as a public way by the Bangor City Council by Council Order No. 219-q passed September 9, 1%3, said point of beginning being 787.40 feet southwest from the southwesterly right-of-way line of Union Street, as measured along said northwesterly line of Sunset Avenue, said point of beginning being an the centerline of that portion of said right-of-way to be discontinued; thence in a northwesterly direction, forming an interior angle of 930 08' 40" with said northwesterly right-of-way line of Sunset Avenue, for a distance of 197.00 feet to a point. The portion of the right-of-way to be discontinued is 50 feet wide, measuring 25 feet at right angles to either side of the above-described centerline, with a 100 -foot diameter cul-de-sac at the northwesterly end, the center of which is coincident with the northwesterly terminus of the above- described centerline. There appeared at the time and place set for the meeting Edward D. Leonard, III, Esq., representing the owner of the adjacent property, Mr. John B. Dyer, who was the original petitioner for the street discontinuance. The discontinuance has been requested because that portion of the roadway has never been constructed, and the right-of-way serves no useful purposes; furthermore, it would interfere with the proposed development of the Dyer land. Mr. Leonard raised the question as to whethea:a public easement would be retained, and the City Engineer indicated that he would recommend -that no public ease- ment was necessary, since there are no existing utilities or other public need to retain such an easement. Mr. Leonard spoke in favor of the proposed discontinuance as proposed. The City Engineer had previous discussions with all of the other property owners on Sunset Avenue, who had been given written notice of the hearing, and none objected to the proposed discontinuance. The question of discontinuance was referred to the Planning Board for their consideration relative to. removing it from the Official City Map, which was approved. A copy of a letter from the Plaming Officer in that regard is attached.
