the City of Bangor dated September 23, 1974, as amended, be hereby
further amended as follows:
By changing a parcel of land located at 1670 Broadway (Tax Map No.
R-31, Parcel No. 5A) from Agricultural Zone to Commercial 3 Zone.
Said parcel containing approximately 1.9 acres and being more
particularly indicated on the map attached hereto and made a part
hereof.

AGREEMENT made this IN day of aLIO~ ' 1982, between
GOPIN S.ROLNICK EQNIPNENT ComT N and ANN K. NARSTON, ERVVIN NARSTON, CORBET
NELSON, BEATRICE NELSON, NARLENE THOMAS, MICHAEL JENKINS, PATRICIA JEWKINS, FRANK'
FAULKNER AND PRNU. FAULKNER.
WHEREAS, Gopin 6 Rolnick Equipment Company petitioned the Planning
Board for a change in the zoning in a portion of their premises; and
WHEREAS, residents of the area actively opposed such zone change; and
NHEREAS, it was deemed appropriate that the parties find an
accomodation satisfactory to both parties;
NOW THEREFORE, it is hereby agreed as follows:
1. A drawing of the physical features of this Agreement
be rendered at the expense, of Gopin fi Rolnick. Equipment Company;
2. A copyof the written Agreement and of the drawing
be supplied to all parties, and one copy of each be submitted
to the Planning Board; -
3. Gopin 6 Rolnick Equipment. Company shall build,
at its expense, a berm on its property:
a) fromthe front of the existing storage
barn to Greeley Street, as if a
extension of the front wall of said
building;
b) 'along the generally southerly side-
line of Greeley Street, the entire
length of that part of its property
rezoned as a result of this Agreement;
c) a continuation of the berm referred
to in sub-paragraph h b) along the entire
length of the generally easterly side-
line of the larston property (set back
sufficiently to allow for the ditch
described in Paragraph 8), a distance
of one hundred twenty-seven and one-
half feet (127.5'); and
d) as continuation of the berm referred
o in sub-paragraph c) along the generally
southerly sideline of the Marston property
from the cornet of said berm, extending
very-eight feet (98')from the g rally
outherly c of said Marston land.
e)- ITe height of the berms shall be three feet
(3'). The berms shall out be leas than nine
feet (9') vide, including slopes. The top
,(flat) portion of said berms shall be centered
and at least one-third (1/3) the widthatthe
entire berm.
6. Gopia S Rolnick Equipment Company shall place an top of
said berme a solid fence of cedar slats. The fenceshall be
finished on the outside, and the height of the fence shall
be four feet (4'). - -
J. Caere d Rolnick. Equipment Company shall build, at
its expense, a ditch three feet (3') wide on its property,
westerly of the berm described in Paragraph 4, subparagraph
c) and easterly of the adjacent Harston property for proper
drainage. The ditch shall be Of a design and construction
consistent with its location adjacent to residential property.
8. Win b Rolnick Equipment Company shall maintain
the berm and fence in good repair.

meeting on September 21, 1981 held a public hearing on the above
nchange request.which was continued to the regular meeting
on October 19. 1981.
The Planning Board recomoended an amendment to the proposed
zone change and recommended. passage` of the amended ordinance by a
vote of three in favor and two opposed to reduce the area
of the
zone change to approximately one acre due to the nature of the
area and its proposed residential use in theComprehensivePlan.

Planning Beard, after a public advertising (at 'least 10 days prior to such public
hearing), for all changes to the coning ordinance of the City of Bangor. The re-
endetion of the Planning Board is then returned to the Bangor City Council for
final action.
