And that the said City Engineer met at the time and place of meeting apecdged in the matters and procmded to lay out said Toad„ as follows:, „ -1- Beginning at a point on the easterly right-of-way line of Hogan Road located 420.00 feet south from a granite monument in said right-of-way line which is located 10.00 feet south from the northerly line of land owned by Webber Petroleum Co., as described in Penobscot Registry of Deeds in Vol. 2604, Page 328, said point of beginning being on the nolherly right-of-way line of the proposed roadway; thence North 8'B 28' 23" East for a distance of 400.00 feet; thence North 6 27' 02" West for a distance of 980.20 feet to the southerly line of land owned by John J. and Matilda S. Davis, as described in Penobscot Registry of Deeds -3- in Vol. 13769 Page. 115; thence North 470 33' 58" East along said Dais line for a distance of 86.51 feet to a point; thence South 6 27' 02" East for a distance of 618.64 feet to a point, being onthenortherly line of said Helfrich property; thence South 83 28' 23" West for a distance of 199.80 feet to the point of beginning.. The above described parcel contains 48,077 square feet. GRADE And the City Engineer proceeded to ley cut a grade for said roadway as follows: Beginning at the easterly edge of the existing Hogan Road pavement at an Elevation of 90.40 feet, Bangor City Datum; thence ascending on a grade of 1.70 per cent for a distance of approximately 369 feet to Elevation 96.67; thence continuing to ascend along a convex vertical curve having a length of 110 feet and an external of 0.1375 feet to Elevation 98.35; thence continuing to ascend on a grade of 0.70 per cent for a distance of 103 feet to Elevation 99.05; thence continuing to ascend on a concave vertical curve having a length of 100 feet and an external of 0.0875 feet to Elevation 100.10; thence continuing to ascend on a grade of 1.40 per cent for a distance of 150 feet to Elevation 102.90; thence descending along a convex vertical curve having a length of 200 feet and an external of 0.850 per cent to Elevation 102.30; thence continuing to descend on a grade of 2.00 per cent for a distance of 275 feet to Elevation 96.80; thence continuing to descend along a concave vertical curve having a length of 100 feet and an external of 0.250 feet to Elevation 95.80. There appeared at the time and place set for the meeting Mr. Edward D. Leonard, III, Esquire representing John Dyer of Ralph Dyer, Inc.; Mr. Paul Rudman, Esquire representing Mary Jane Helfrich; Mr. Paul�Giaffam representing Webber Petroleum Company; and the City Engineer. The City Engineer proceeded to describe the proposed laying out, indicating to those present the various parcels of land which were to be acquired for the construction of the roadway, and outlining the recommended damages for said acquisition. This would include payment to Mary Jane Helfrich in the amount of $4,500.00, and to Webber Petroleum Company in the amount of $10,500.00. These costs were based upon a previous Appraisal of the Webber property which was undertaken by the City. It was further pointed out that no payment would be made for the acquisition of the Dyer property or the Davis property, since they had originally petitioned for the roadway construction. The City Engineer also outlined the estimated assessments for the construction of the road and sanitary sewer, and indicated that all of the parties being assessed had previously indicated that they were in favor of the project. Those present were advised that the assessments would undoubtedly be less than the original estimates due to substantially lower bids which have been received for construction, and reminded those present that payment of the estimated assessments would be required prior to the start of construction. -4- None of those present objected to the proposed acquisition or construction. although Mr. Grafted indicated that Webber Petroleum requested an additional Appraisal to verify the proposed damages to be paid to them. It is recommended that the roadway be constructed as described above, to be named and known as "Haskell Road".
