ORDERED,
THAT, in accordance with the provisions of Chapter XI, Article
4, of the Laws and Ordinances of the City of Bangor, the Zoning and
Code Enforcement Administration Officer be authorized to issue a
Mobilehome Park Construction Permit for Birch Hill EstatesMobilehome
Park as recommended by the Bangor City Planning Board and subject to
the conditions attached by the Planning Board at its meeting on July
6, 1981.

Subject: Birch Hill Estates Trailer Park
Thin office has reviewed the latest Plane dated May 229
1981 for the subject project, and offer the following comments:
1. The lots are not numbered and the streets are not
identified on the set of Plans which I have, no that it is
difficult to describe the exact location of deficiencies.
2. On the Revised Lotting Plan, it appears that there
are nine existing trailers which are too close to the right-
of-way, being the road extending northwest from the circle.
3. There is one proposed trailer on the northeasterly
side of the project area which is too close to the boundary
line, being adjacent to property owned by the Eastern Maine
Association for the Retarded, Inc.
4. On the Drainage Plan, the following comments are
offered:
(a) The Plan does not indicate where the drainage
outlets along the southwest side of the project drain to, the,
first point of concern being the existing 15" Pipe outlet
located approximately 500 feet northwest of Judson Boulevard.
It would appear that this drains towardthe future residential
subdivision area.
(b) I seriously doubt that the existing 12" storm
drain has sufficient capacity to take the flow from the area
above. It is felt that the Engineer should verify that it. has
sufficient capacity, or the pipe should be replaced with a
larger pipe.
(c) The next drainage swale extends in a southerly
direction, and apparently dumps directly onto Judson Boulevard.
This should be connected into the existing catch basin on Judson
Boulevard by a 15" minimum pipe connection into the side of the
catch basin.
(d) The drainage ditch on thesoutheastside, nearest
to Judson Boulevard, connects into the existing 24" line on
Judson Boulevard. This may suffice, although I believe that

we should have assurance from the Engineer that drainage cal-
culations will support the additional volume of flow into that.
sewer.
(e) The most southerly storm sewer discharge enters
an existing drainage seals which parallels Balsam Road, which
in turn is connected into a 24" storm sewer on Balsam Road by
a catch basin. I do not believe that the single catch basin
grate will take the entire volume of water which this line would
intercept, and would suggest that the catch basin should be
removed, the ditch deepened, and the end of the 24" pipe rap -
rapped to receive the flow. Again, the Engineer should give
assurance that the flow calculations do not indicate that the
existing 24" line will be overloaded.
(f) In the easterlT corner of the project, there
are two catch basins and a 15' sewer, and it is not clear as
to where the sewer discharges. It would appear to be headed
toward the land bordering the southeast side of the project,..
the ownership of which is not sbown.
5• On the Utility Plan, a pump station is indicated
in the northeast corner of the project. It is felt that more
specific information should be given to this unit,. i.e.,
.capacity, standby generation, overflow, etc. - -

SUBJECT: Mobilehome Park Construction Permit for Birch Hill
Estates
The BangorPlanningBoard at its regular meeting of July b,
1981 held a public hearing on the above requested Mobilehcme Park
Construction Permit in accordance with Chapter X1, Article 4 of
the Laws and Ordinances of the City of Bangor.
The Planning Board voted five in favor and none opposed to
recommend approval of the Construction Permit to the City Council
subject to the following conditions:
1) Deletion of Lot # 239
2) Relocation of the mobllehome on int 93 so that it is at
lease 10 feet from the southwest streetline.

Subject Birch Nall Estates. Application for Hobilebome Park Construction
Permit, Special Exception and Site Pleas Apprcral under Application #333-81
In accordance with Chalker %1, Article 4, Section 1.4 Of MY Ordinances, I
have forwarded to the City Enginmr and to the City Health Officer one set each
of the plems for the above referenced project and offer the following ea ments
for your considerations
(1) Along wbst has, in previous submissions (most recently, December, 17, 1980),

Westerly aide, there are six lots which do nat meet the setback requiremards
contained ire Chapter XI, Article 5, Section 1.7.3• Peferencivg the lot
numberige system employed by the applicant in a previous submission of
December 179 198D, these lots were described as Lot #A-7; this lot as pre -
scaly configured depicts a ten foot setback from the Avtreet right-of-way
code a twelve foot setback fret the E reet right-ofway wham a twenty
fact setback is required. Lah numbers A-6, A-5, and A-4, respectively,
depict a twelve fact setback from the A�treet right-of-way where twenty
feet am required Lot A-3 depicts thirteen fact and, lot A-2 depicts
seventeen fast share twenty feet aro required.
(2) I ON informed by the applicant0s agent, Oran G. 'Twitchell, that the
applicanf wlehes to request a waiver from these requirements, in a
special provision of the Nobilehone Park Ordinance, chapter Me Article
50 Section 3•
(3) Alone the interaction of A and D Streets, the first lot an the left,
formerly timbered �A-14; is a ten foot setback from the rightbS-way on
DStreet; ten fact setback from the right-of-way, along AStreat, where
twenty feet am mgaired; Lot numberi A-16, the second lot On the left,
is located ten feet where twenty feet arerequired.from the right-of-way
on AStreet; Lot number D-1, the first lot on the right at this inter-
section is located one foot from the AStreet rigbtbf-way whew twenty
feet are required and nineteen feet from ➢Street where twenty feet are
required.
I recommend that the Planning Board great the waiver requested under the
Special ProviSim section of the Mobilehome Park Ordinance, I further recommend
that aPProval of the Mabilehme Perk Construction permit be conditioned upon
either the relocation of mobllehnaeelocated at lot mwbere 1111`D-14,�atxtn-l6��
m u to conform to the requirements of the Ordinance ox, (shoald'3� ettorn
find this acceptable) that approval be conditioned upon relocation of these p ds
at the time of replacement oP a new mobilehme. In regard to condition saistdng

I do not believe that these condition are in and way baaardms, a poor design,
or unsightly. However, there being no provision for a waiver m a Variance
from the requiremed andr by virtue of the fact that this is a self-imposed
hardship, I most recmmend that the terms of the Ordinance either be fully met
or, that this matter be negotiated io the reasonably foreseeable future.
Upon acceptance of either of these conditions, I would not be aware of any
raasm wily Special EraePtim and Site Plan Approval should not also be graded

The applicant should be reminded that after securing approval of these peace
mita, the applicant moat immediately secure a temporary occupancy Permit and,

Me is to advise you that 1 have reviewed the set of place for the
Birch 8511 Estates Mobilebome Park off Broadwar and tomato Road
and developed by Judson Grant.
Based on review of these place and prior kro ledge of the developing
site Rum field visits by Earle Refuse formerly of this Department:
I find no public health Problems with the development which w d
prevent its approval by the City or Planning Board.
It should of course be notedv that Mr. Giant ought to be required
to provide assurances that properly designed aM installed sewer
and water correctors will be provided for each un.t located in the
Park and that when aro trailer pads are empty: the correctors will
be Properly capped off.
