ORDERED,
TORT Francis Woodhead, Chief of Police, is hereby authorized and
directed, on behalf of the City of Bangor, to enter into an agreement, a
copy of which is onfile In the office of the City Clerk, for purposes
of permitting the ,participation of the Bangor Police Department in the
Penobscot County Criminal Justice Management Information System.

User Agreement
I. Parties cowl DoeneentsI
This agreement is made and executed this .day of
1981 by sed among the following agencies: -
The Bangor Police Department
The Brewer Police lepartment
The Hampden Police Department
The Old Toon Police Department
The Orono Police-Bspartm®t
The Penobscot SherifffIs Office
The University of Maine Police Department
Purpose-.
This agreement shall set forth the financial and operational responsibil-
ities accepted by each agency or municipality which participates in the Panob-
seot County Criminal Justice Management Information Systmc.
In addition to the tam of this agreement: each participating agency or
municipality shall agree to be bawd by the terse sed conditions of the contract
between the County of Penwbacot end Mind Systemse Ineorporatedr Of Oraz:ger New
Jersey: made Januuy 1: 1981•
It is understood that this agreement shall remain in force on are ongoing
basis. Notification of say agencyss or munielpallties withdrawal nom this
agreement must be seared at least 90 days prior to that withdrawal, Providad
that current, year cost obligations must be and to the date of withdrawal.

II. Project Marugamantx
A. Project Committee.
Each over agvmy, shall appoint one system representative and, at their
ddscretiey one assistant system representative to serve as a member of a
project mragement committee. Each agency or municipality shall have only
one vote regardless of the number of represe,Ratives they have on the
committee and no committee member, regular or advisory, stall have the
authority to obligate agency, or ®ndcipal forts. In additio% ons Penobscot
Counby Commissioner shall serve as an advisory member of the committee with-
out voting rights.
All decisions or recommendations made by the Project Manages nt Committee
must be ratified by at least two thud. of the entire committee.
B. System Managar.
The Project Management Committee shall select one member to serve as
Systeme Manage, The System Manager shall act as moderator a.i coordinator
of all committee functions, and shall be responsible for timely reports to
the Penobscot County Commissioner regarding project development and progress.
In additiory the System Manager shall have the authority to physically die-
connect ary user from the computer eyetem on an amergenq basis pending the
resolution of any security or system threatening oeeurance. The determination
as to when a state of emergency exists shall be in the sole discretion of the
System Manager. In aro such case, resolution shalt be attempted at once via
the Project Management Committee ane arq necessary consultants.
Me System Manager and members of tb'e Project Mawgement Committee shall
carve without compensation other than that provided by their respective
agencies.

C. Duties of the Project Management Committee:
The duties of the Project Management Committee shell include the following:
1. lavestigatinn em rewmmmdations regarding say changes in -
system configuration: hardware. or software,
2. The development of operational policies.
3. Interface kith other information management systems or noo-
war agencies.

6. The negotiation of Paters hamware and software maintenance
contracts.
7. The coordination of cooperative fundi 9 for ongoing system coats.
It is agreed that on agency or municipality will attempt to make any
hardware or softwaremcdifdcatiary addition or deletion without Project
Managemet Committee approval.
III. Agreements: -
A. Each remote use agency shall accept the wets of the communication link
betwem their terminal and the computer mainframe housed at the Bangor Police
Station. Such wets shall includev but are not limited to, telephone lease
line costs: hard wire. costs, or argt form of radia link wets. In adflitiont
the cost of any additional computer hardware or equipment not nwmsary for
basis system operatiooq shall be borne by the near agency initiating the purchase.
Mia shall apply to both acquisition costs and ongoing maintenance wets of such
hardware or equipment. - ..
B. The ongoing wets of the electrical power necessary to operate the remote
user terminals shall be borne by those near agencim.
C. The Bangor Police Department shall accept the responsibility for housing the
wmpater winframe, maintaining its environment: and arranging necessary service
or maizhenance. -

D. The ongois8 costa of the electrical power necessary to operate the
computer mainframe at the Bangor Police Department stall be borne in full
by the Bangor Police Department sod any other nessy which is hard etred
ddrectly to the computer nainframe and has no ongoing coneuntcetion 15 n4
cost.
M. in the event of airy ongoing tomnunicatian linty between the Penobscot
Country Crlmiael Justice management Formation System and Far other infor-
mation menagaant system, such costs shad be sham equally among all seer
agencies.
P. The ongoing cost of hardware maintenance for the computer system shall
be shared on an equal beats among all neer sgencdss. The cost of hardware
m=<..tOcarte for the first twelve m utbs of operation shell be paid by Penobscot
County subgrant facts. After that period, owing hardware maintenance shall
be negotiated with Mia¢ Systeusr lncorporated or some other suitable vendor.
C. Toe cost of ary necessary "all perils" insurance coverage shall be shared
On an equal basis among all peer agencies.
M. The cast of software ma teranee for the computer eystm shell be shared us
an equal basis among all user agencies. The cost of software maintenance for
tba period of January 1, 1981 through March 31, 1982, shall be paid by Penobscot
County subgraht foods. Prior to March 31, 1982, ongoing software maintenance
shall be negotiated with Mini. Systema, Incorporated or some other suitable vendor.
I. The Department of Public Safety's "Metra Manual^, the M.C.I.C, user manual,
the user console provided by M pyatems, Incorporated, Out any other operational
manuals selected or developed by the Project Management committee sball provide
the only acceptable message ami protectors forts for the use of the Computer
System.

J. Each participating agency or municipality agrees to comply with Title 16
H.R.S.A., 'Tun Crimp*_s History Record Information Acte In regards to the use
or release of aro police intormatiom. All steps will be taken to protect
public Privacy and coKSdertiality.
H. g participating agency or municipality agrees to comply with all the
general or special conditions imposed on Penobscot County's subgrant award

L. The Bangor Police Department shall aco%p the responsibility for daily
memory back-up and storage and the se ty of system bacp and dooumntation.
H. For purposes of indemnification of participating agencies and/or mundcipal,
ities against any losses, damages, or liabilities arlsing out of the use or
services of the Pnobsoot County Criadnal Justice ManagemerAIufonaetion System,
the offending agency, charged with such loss, .damage, or liability and its
mvdoipality shall._alone

damages, or liabilities,
