Resolve Passed ty Clerk - CITY OF BANGOR (TITLE) Resolve; Requesting consideration by the Maine State Housing Authority of the proposal of Burson & Burson By the City Council of the City of Bangor: RESOLVED, WHEREAS, on February 10; 1979; the Maine State Housing Authority advertised for proposals for the development of thirty-two (32) housing.units at the gas works site on Main Street in Bangor; and WHEREAS; fourteen (14) proposals for the development of the site were submitted to the Maine State Housing Authority; and WHEREAS; on April 20; 1979 the Maine State Housing Authority selected Kurson & Burson as the developer of the site; and WHEREAS, Kurson & Kurson proceeded to prepare develop- ment plans and expend effort and money in connection therewith; and WHEREAS; on September 17; 1979 the Planning Board of the City of Bangor approved the development site plan; and WHEREAS; on September 19; 1979 the Bangor Housing Authority gave its consent to the designation of Burson & Kurson as the developer; and WHEREAS; the City Council for the City Of Bangor on. September 24, 1979 gave its consent to Burson & Kurson as the developer; and WHEREAS; the developer paid a commitment fee to and was issued a commitment financing from Bangor Savings Bank on October 20; 1979; and WHEREAS, on the strength of the approvals granted to it; the developer proceeded to expend funds and make commitments for the preparation of construction plans and specifications; which plans and specifications were approved by the Maine State Housing Authority on November 2; 1979; and WHEREAS, construction of the site was to have commenced on or about January 1; 1980; and WHEREAS, on or about December 1, 1979 the existence of petroleum waste on the site was disclosed; and WHEREAS, the removal efforts prevented the developer from commencing construction; and WHEREAS, it has now been determined that the site in its present condition is unsuitable for the construction of housing; and NOW, THEREFORE} in recognition Of the good faith effort Of Kurson 6 Kurson to develop the gas Warks site, which effort failed through no fault of Burson 6 Kurson, be it resolved, by the City Council of the City of Bangor that the City Manager be and hereby is instructed to request Maine State Housing Authority to consider the application of Korean 6 Kurson for the develop- ment of housing within the City of Bangor in connection with the Authority's consideration of other currently pending proposals. - 2 -
