HomeMy WebLinkAbout2020-05-11 20-155 Order 05/11/202020-155 05/11/2020 20-155 Finance Order 031-051A Title, Order Amending Council Order 19-378, Disposition and Development of a Single Family Home Located at 40 Nelson Street This Order would amend the terms and conditions, approved by Council in its September 23, 2019 meeting, for the purchase and development of 40 Nelson Street to R&B Developers, Inc. Because of complications stemming from COVID-19, which included the closure of City Hall, the closing on the sale of land at 40 Nelson Street to R&B Developers, Inc. was postponed. The conditions in Council Order 19-378 include a May 1st deadline on obtaining building permits. R&B Developers, Inc., without having right, title or interest to the property, could not obtain said building permits. R&B Developers, Inc. is now anticipating a July start date to the development of the 40 Nelson Street property and is requesting that the aforementioned deadline be extended to July 1, 2020. This order addresses the Council goal of improving quality and quantity of housing to meet demand for workforce housing, life cycle housing, and supportive housing within the community. Consent 05/11/202020-155 CITY OF BANGOR ORDER 05/11/2020 20-155 Nichols Amending Council Order 19-378, Disposition and Development of a Single Family Home Located at 40 Nelson Street WHEREAS, the Council, through Council Order 19-378, authorized the Disposition and Development of vacant property located at 40 Nelson Street to R&B Developers, Inc.; WHEREAS, the Could Order 19-378 including the condition that any necessary building permits be obtained by May 1, 2020; WHEREAS, due to complication from COVID-19, including the closure of public buildings, the closing of the sale of 40 Nelson Street to R&B Properties was postponed, WHEREAS, R&B Developers, Inc. could not obtain the necessary building permits without a right, title, or interest to the land, and WHEREAS, R&B Developers, Inc. is requesting that the aforementioned May 1, 2020 deadline be extended to July 1, 2020: BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR, THAT The City Manager is hereby authorized, on behalf of the City of Bangor, to execute a development agreement for the development of a single family house located at 40 Nelson Street and all those documents necessary for the transfer of title of said 40 Nelson Street (Map and Lot 031-051A) to R&B Developers, Inc., under the following conditions: 1. The developer shall purchase the property for $16,300. 2. The developer shall spend a minimum of $177,000 on the development of the proposed single family home. 3. The developer shall obtain a building permit on or before July 1, 2020. 4. The developer shall complete the project and obtain a certificate of occupancy within one year of obtaining said building permit. The final documentation will be in a form approved by the City Solicitor's Office.
