BROGNTAS, of Bangor, County of Penobscot, State of Maine, in consideration of One Dollar ($1.00) and other valuable considerations paid by CITY OF BANGOR, a municipal corporation, located in the County of Penobscot, State of Maine, the receipt of which is hereby acknow- ledged, do hereby give, grant and convey unto said City of Bangor, its successors and assigns forever, subject to the restrictions contained herein, the full right and privilege to excavate for, install, replace, maintain, and use an underground sanitary sewer and appurtenant structures thereto, in, over and across a certain twenty (20) foot -wide strip of land, the center line of which is described as follows: Beginning at a point on the southwesterly line of the parcel of land described in deed from Northeast Bank b Trust Co., Executor of the Last Will and Testament of Charles Walker TenBroeck, Jr_, a/k/a Charles W. TenBroeck, Jr., to the Grantor, dated June 13, 1973, recorded In the Penobscot County Registry of deeds in volume 2376, Page 145, which point of beginning is ninety-three (93) feet northwest from the northwesterly right-of-way line of Meadowbrook Road, as measured along said southwesterly line of said land of the Grantor; thence deflecting to the north at an angle of approximately 240 with said southwesterly line of said land of the Grantor and extending for a distance of eighty (80) feet to a point on the northwesterly line of said land of the Grantor, which point is thirty- five (35) feet northea at from the westerly corner of said land of the Grantor. Said underground sanitary sewer shall be located along said centerline of said twenty (20) foot wide strip, as shown on Plana prepared by James W. Sewall Company of Old Town entitled "City of Bangor, Maine, East Penobscot Interceptor Sewer, EPA Project No. C230154-02" dated August, 1980, with the original of said Plans being on file in the office of the City Engineer. The right of ingress to and egress from said sanitary sewer shall be in, over and across said twenty (20) foot wide strip of land and no other portion of the Grantor's land. Said twenty (20) foot wide strip of land is a portion of the parcel of land describedin the aforesaid deed from Northeast Bank s Trust Co., Executor of the Last Will and Testament of Charles Walker TenBroeck, Jr., a/k/a Charles W. Tenbroeck, Jr., to the Grantor, dated June 13, 1973, recorded in the Penobscot County Regis- try Of Deeds in Volume 2376, Page 195. The City of Bangor, its successors and assigns, by the acceptance of the right and privilege hereby conveyed agrees that after each entry upon said premises for the aforesaid purposes, that it will promptly restore the surface of said premises to the same condition as prior to such entry. The Grantor agrees that no permanent buildings shall be placed within ten (10) feet from the centerline of the sewer as described above, but that she, herheirsand assigns, shall other- wise have full use and enjoyment of her property. The Grantor, and her heirs and assigns, may enter the sewer without charge, but nothing herein shall be construed as to except said Helen G. Brountas, her heirs and assigns, from pay- ment of sewer user fees and street opening charges. Nicholas P. Brountas, husband of the said Helen G. Brountas, joins in this Agreement to release all his rights in the easement herein granted. IN WITNESS WHEREOF, we have Executed these presents this S day of January, A.D., 1981.
