HomeMy WebLinkAbout1981-01-12 81-67 ORDER81-6] Introduced by Councilorsoucy, January 12, 1981 CITY OF BANGOR (TITLE.) @1rberyn Relative to Condemnation of a Building or Structure Located at 50 Patten Street, Bangor, Maine - Dan- 11gerous Building 11 By the CRY CmutE of the CIV WBouuor: ORDEMA THAT WHEREAS, the Bangor City Council, in itsppachy as the Municipal Officers of the City of Bangor, held a public ahearing pursuant to 17 M.R.S.A. §§ 2851 at seq. to determine whether or not the building or structure located at 50 Patten Street, Bangor, Maine, on a lot des- cribed as the first parcel ina Warranty Deed recorded in volume 2681, Page 325, Penobscot Registry of Deeds and owned by Albion K. Smith, Sr. and Pauline E. Smith, constitutes a dangerous building within the meaning of said statute; and WHEREAS, 'based upon the evidence presented at said public hearing, the Bangor City Council finds that the building or structure in question is structurally unsafe; unstable; a fire hazard; unsuitable or improper for the use or occupancy as a residence; a hazard to health or safety because of inadequate maintenance, dilapidation, obsolescence or abandonment, and dangerous to the life or property of the inhabitants of the City of Bangor; and WHEREAS, the Bangor City Council hereby adjudgessaid building or structure to be a nuisance and dangerous, as provided in Title 17 M.R. S.A. §§ 2851 at seq., - NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT said building or structure shall be disposed of as follows: (1) Said building or structure shall be demolished by the owner(s)within thirty (30) days of the date of passage of this Order, said demolition to be in conformity with the Laws and Ordinances of the City of Bangor; (2) In the event said building or structure is not demolished within thirty (30) days as provided above, the City Zoning and Code Enforcement Administration Officer may cause said building or structure to be demolished, all expenses incurred thereby to be paid by the owners) or assessed against the property in accordance with 17 M.R.S.A. 5 2853. (3) The owner(s) of said building or structure shall remove all personal property located therein, and in the event that the owner(s) fail to comply with this Order, the City Zoning and Code Enforcement Administration Officer may remove and dispose of said personal property. AND BE IT FORMER ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT the City Solicitor, or his representative, is hereby authorized to take any and all actions necessary to secure the demolition of said building or structures.. S 2851 at. seq., the building or structure located at 50 Patten Street, Bangor, Maine, on a lot des- cribed as the first parcel in a Deed recorded in the Penobscot County Registry of Deeds in Volume 2681, Page 325 and owned by Albion K.
