BY City Coww.ii of Rn age Of Bosomy RESOLVED, THAT the City of Bangor acquire by eminent domain, pursuant to its duly adopted Community Development Program, all the right, title, interest or estate, legal or equitable, of Patrick Wall, John Welsh, Thomas J. Welsh, Stephen Welsh, T. Edward Welsh, Katherine B. Welsh (heirs of John Welsh), Mary Connors, James Connors, Ellen A. Givren (heirs of Mary Connors), and'all persons known and unknown claiming under or through the aforesaid persons and owners unknown, or their heirs, devisees, legal representatives, successors, assigns, grantees, trustees in bankruptcy, receivers, disseisors, creditors and Lienholders and any and all other persons unascertained or not, in being or unknown, or out of the State, and all other persons who may claim any right, title, interest or estate, legal or equitable, in the within described land and real estate through or under the above- named persons. Said premises being more particularly described as follows: A certain lot or parcel of land, approximately eight (8) feet by sixty (60) feet, situate on the southerly side of Hancock Street, Bangor, Maine, bounded and described as follows, vis: Beginning on the south- erly side of Hancock Street at a point located at the northeast corner of a parcel of land described in a Warranty Deed from Patrick Wall to Michael Hinds dated December 14, 1853, and recorded in the Penobscot County Registry of Deeds in Volume 240, Page 509; thence southerly along the easterly line of said Hinds parcel fora distance of sixty (60) feet; thence easterly at a right angle a distance of eight (8) feet to the westerly line of a parcel conveyed from Patrick Wall to John Welsh by a deed dated October 29, 1853 and recorded in said Registry in Volume 239, Page 391; thence northerly along the westerly line of said Welsh parcel for a distance of sixty (60) feet to Hancock Street; thence westerly along Hancock Street a distance of eight (8) feet to the point of beginning. Meaning and intending to describe the eight foot passageway reserved by Patrick Wall and his heirs in the aforementioned deed from Patrick Wall to Michael Hinds. BE IT FURTHER RESOLVED by the City Council of the City of Bangor that the total amount of damages determined to be just compensation for the acquisition of the above-described property interest is One Dollar $1_00);; STATEMENT OF FACT: The purpose of this eminent domain action, pur- suant to 30 M.9 -5.A. S 4854, is to cure a passible defect in the title to an eight (8) foot strip of land extending southerly from Hancock Street between a parcel of land acquired by the City of Bangor from Harold A. Baron by a Warranty Deed dated June 1, 1978, recorded in the Penobscot County Registry of Deeds in Volume 2869, Page 15 and a par- cel of land acquired by the City of Bangor from Springer Realty Cor- poration by a Quitclaim Deed dated October 29, 1980, recorded in said Registry in Volume 3133, Page 320.
