ORDERED,
THAT the City Treasurer be and hereby is authorized to
accept the attached sewer easement Agreement from the Bangor
Humane Society for the construction of a portion of the
Penjejavoc Stream Interceptor Sewer, to be done as part of
the East Penobscot Interceptor Sewer project.

AGREEMENT
KNOW ALL MEN BY THESE, PRESENTS, That BANGOR HUMANE SOCIETY,
a corporation, of Bangor, County of Penobscot, State of Maine,
in consideration of One Dollar ($1.00) and other valuable con-
siderations paid by CITY OF BANGOR, a municipal corporation,
located in the County of Penobscot, State of Maine, the receipt
of which is hereby acknowledged, does hereby give, grant, and
convey unto said City of Bangor, its successors and assigns
forever, subject to the restrictions contained herein, the full
right and privilege to excavate for, install, replace, maintain,
and use an underground sanitary sewer and appurtenant structures
thereto, together with the right to ingress thereto and egress
therefrom in, over and across a certain lot or parcel of land
situate on Meadowbrook Road in said City of Bangor as described
in Deeds recorded in Penobscot Registry of Deeds in volume 19139
Page 341 and volume 1976, Page 30. Said underground sanitary
sewer ahalr be located as shown on Plana prepared by James N.
Sewall Company of Old Town entitled "City of Bangor, Maine,
East Penobscot Interceptor Sewer, EPA Project No. C230154-02"
dated August, 19809 with the original of said Plans being on
file in the Office of the City Engineer, said location more
fully described as follows: -
An 18 inch sanitary sewer, commencing at a point on the
southerly right -o£ -way line of Mount Hope Avenue located 407
feet, more or less, west from the easterly property line of the
Grantor, as measured along said southerly right-of-way line;
thence deflecting 590, more or lees, to the southwest from a
westerly extension of said Mount Hope Avenue right-of-way line,
and proceeding for a distance of 268 feet, more or less, to a
manhole; thence deflecting approximately 35" to the left in a
southeasterly direction for a distance of .320 feet to a maN,ole;
thence deflecting 120, more or leas, to the left for a distance
of 400 feet to a manhole; thence deflecting 170, more or less,
to the left, for a distance of 181 feet, more or leas, to the
northerly property line of land owned by'Helen G. Brountas as
described in a Deed dated June 13, 1973 and recorded in Penobscot
Registry of Deeds in Vol. 2376, Page 145.
Also, another section of 18 inch sanitary sewer, commencing
on the northwesterly right-of-way line of Meadowbrook Road 49 feet,
more or less, southwest from the southwesterly property line of
said Helen C. Brountas property, as measured along thenorth-
westerly right-of-way line of Meadowbrook Road; thence in a
northerly direction for a distance of 115 feet, more or lees,
to the southwesterly line of said Brountas property at a point
located 91 feet northwest from the northwesterly right-of-way
line of said Meadowbrook Road, as measured along said south-
westerly property line.
The City of Bangor, its successors and assigns, by its
acceptance of the right and privilege hereby conveyed agrees
that after each entry upon said premises for the aforesaid
purposes, that it will promptly restore the surface of said
premises to the same condition as prior to such entry.
The Grantor agrees that no permanent structures will be
placed within ten (10) feet from the centerline of the sewer
as described above, .but that it shall otherwise have full use
and enjoyment of its property.
The Greater, its successors and assigns, may enter the
sewer without charge, but nothing herein shall be construed
as to except said BangorHousesSociety, its successors and
assigns, from payment of sewer user fees and street opening
permit chargee.
IN WITNESS WHEREOF, the said Bangor Humane Society has
caused this instrument to be executed and its corporate seal
to be affixed hereto, by Robert N. Haskell, its President,
duly authorised, this 5th day of November , A.D. 1980.
