(TITLE.) (jorbtrr Relative to Condemnation of a Building or Structure
Located at 79 Cedar Street, Bangor, Maine --Dangerous Building..

WREREAS, the Bangor City Council,in its capacity as the Municipal
officers of the City of Bangor, held a public hearing pursuant to
17 M.R.S.A. §§ 2851at seq, to determine whether atnotthe building or
structure located at 79 Cedar Street, Bangor, Maine, on a lot described
in a deed recorded in Volume 2202, Page 695, Penobscot Registry of Deeds,
and owned by K and K Enterprises Inc., and Samuel J. Schnitz A/K/A
John Kobritz in his individual capacity and in his capacity as president
of K and K Enterprises, Inc., constitutes a dangerous building within the
meaning of said statute; and
WHEREAS, based upon the evidence presented at said. public hearing,
the Bangor City Council finds that the building or structure in question
is structurally unsafe; unstable; afire -hazard; unsuitable or improper
for the use or occupancy as a residence; a hazard tohealthor safety
because of inadequate maintenance, dilapidation, obsolescence or
abandonment, and dangerous to thelife and property of the inhabitants
of the City of Bangor; and
WHEREAS, the Bangor City Council hereby adjudges said building or
structure to be a nuisance and dangerous, as provided in Title, 17 M.R.S.A.
§§ 2851 at seq.,
NM THEREFORE, By the City Council of the City wf Sungari
ORDERED, THAT said building or structure shall be disposed of as
follows:
(1) Said building or structure shall be demolished by the
owners) within thirty (30) days of the date of passage of' „
this Order, said demolition to be performed in conformity
with the Laws and Ordinances of the City of Bangor; and

(2) In the event said building or structure is not
demolished within thirty (30) days as provided above,
the City's Zoning and Code Enforcement Administration
Officer may cause said building.or structure to be
demolished, all expenses incurred thereby to be paid
by the owner(s) or assessed against the property in
accordance with ll M.R.S.A. 5 2853; and
(3) The owner(s) of said building or structure shall
remove all personal property located therein. In the
event that the owner(s) fail to comply with this Order, _
�the City's Zoning and Code Enforcement Administration
Officer may remove and dispose of said personal property,
and be it further
ORDERED, THAT the City Solicitor, or his representative, is hereby
authorized to take any and all additional action necessary to secure the
demolition of said building or structure.

Basically the only change, in the premises during the past Fear
has been the removal of some of the debris from the back yard,
and removal of a portion of the back of the structure. The
latter appears to have bean done recently. The structure remains
easily accessible to anyone desiring entry. I would direct your
attention to the inspection photographs, particularly the one
that shows a large section of new concrete foundation wall that
has fallen into the cellar this past year. _
In summation, the building continues to deteriorate, has
remained a nuisance and a hazard to the neighborhood, and the
owner has not taken adequate measures to support and secure the
building in over a year`s time. For these reasons, I recommend
condemnation and demolition to be completedthis fall.

This building is a one and one-half story wood -framed
structure that has been vacant for some time. It has numerous
structural deficiencies. The original foundation was constructed
of a brick wall bearing upon a stone wall. Sections of the
east and west walls have been replaced with poured concrete,
and the southerly end of the east wall has been replaced with
concrete block. There are several cracks in the concrete
sections and the block section also has cracked and deter-
iorated considerably. The remaining sections of the original
brick and stone wall have been pushed inward, the most severe
instance being located under the ell on the easterly side of
the house, as shown by the inspection photographs. A portion
of the stone foundation is missing in the vicinity of the water
service entry, and shows signs of rodent activity. Interior
support is provided by three columns, one wood, one brick, and
one metal post. All three have settled into the dirt cellar
floor, and have tipped sideways, thus affording questionable
support to the structure. As a result, the upper floors sag
approximately six inches in the middle of the building. Evidence
of settlement is also clearly visible in the roof planes. The
rear portion of the building, which appears to be an addition
to the house, is in very poor structural condition as can be
seen in the inspection photographs. It is completely open,
providing easy access to the cellar and the rest of the struc-
ture. There is also a considerable amount of debris and
rubble behind the building.
In summation, No. 79 Cedar Street has numerous structural
problems, most notably the foundation and interior supports,
and the addition on the rear of the building. A considerable
amount of work would have to be done to bring the structure to
acceptable standards. If the owner is given the opportunity to
attempt this, than the first priority should be to completely
raze the rear addition and clean up the debris, as these presently
pose a fire hazard and a threat to the safety of children or
others who might wander onto the property. I would recommend
that the owner be required to complete this work and completely
secure the building this year. If this is not done, then the
City ought to consider condemnation, in view of the fact that
the owner has allowed the building to remain in its present
condition for a considerable length of time already.
