William Beutel, Chairman Zoning Board of Appeals Dennis "Don" Soucy, Mayor City of Bangor Dear Bill and Don, In the last year or so I have found It Increasingly difficult to attend Zoning Board of Appeals meetings due to frequent time and date changes. This has created a burden on my dental practice because patients are scheduled weeks and months In advance. The most recent change to Tuesday afternoons ( of which I bad no knowledge until after the fact) has proven Incompatable with my practice. Therefore, in all fairness to the board and applicants for relief through the appeals process, I.feel it proper to regretfully tender my resignation. It has been my pleasure to serve on the board these past few years as I feel each citizen has an obligation to contribute what he or she can to the betterment of the community. (IRR of ?gangut, cAlairm LEGAL DEPARTMENT June 17, 1982 Bangor City Council Bangor Maine 04401 Be; .Appointment of Associate Member to the Zoning Board of Appeals Dear Council Memberst Dr. Randon Bragdon hes tendered his resignation as an Associate Member of the Zoning Board of Appeals, and it is my understanding that an Order accepting his resignation and an Order authorising appointment of a replacement will be placed on the agenda for the Council Meeting of June 28th. In addition, due ta other commitments, Bill Beutel has been unable to attend the last 6 meetings of the Board of Appeals, and it is anticipated that this situation will continue for some time. Therefore, the Board currently has only 4 active members and me active Associate member Me hear and decide administrative and/or varia sea appeals. Since the Zoning Ordinance k s four (4) votes for the granting of a arias and/or administrative appeal, ethe Board hes traditionally allowed the applicants a full 5 -member complament to hear appeals. Therefore, under the current circumstances, the Board hes been forced to continue a number of pending items either because of aconflict of interest of a member Or the absenceOf a ember. For ample, all 4 Items scheduled for the June 15th meting had to be continued due to the absence of me of its activemembers. Furthermore, even if that member tad been present, one item would have had to have been continued anyway due to a conflict of interest of one other Board member Doe to the aituation outlined above, the Board requested at its Jose 15th meeting that 'I contact the Council to urgenexpeditious appointment of -a replacement for Dr. Bragdon. At the present time, it appears that at. lease a item pending before the Board will have to be continued until such time as .a replacement is appointed. The Board is concerned that such e Bangor City Council June 17, 1982 Page 2 situation serves neither the best interests of the City nor the applicant. Although I realize that the Council generally continues an appointment Order until a pool of applicants can be obtained for consideration, I a believ it is the Board's opinion that this particular vacancy should be filled as some as possible.
