AM that the said City Engineer met at the time and place of meeting specified in the uotieea and proceeded to by out said Eas enents as £oll s: Do Beginning at an existing manhole located on the Dow Field Sewer at the intersection of an existing 24 inch interceptor sewer pipe connection extenging northeasterly to the Treatment Plant; thence deflecting 39 55' 42" westerly from a southwest- erly extension of said 24 inch interceptor sewer pipe, and extending for a distance of 17.6 feet, more or less, to a pproposed manhole located on land owned by the Plaine Central Ra�lroad Company; thence deflecting in a northwesterly direction 31 59' 39" from the last described line and extending under an existing spur track for a gistanne of 33 feet to a proposed man- hole; thence deflecting 81 51' 58" in a southwesterly direction from the last described line, and extending 338 feet scrogs Railroad lend to a proposed manhole; thence deflecting 13 13' 21" in a westerly direction from the last described line and extending 438 feet to a proposed manhole located on the Town Line between Bangor and Hampden, said sewer crossing land owned by the Maine Central Railroad Company, Irving H. and Julia S. Ayer Louis P. and Laurette E. Paradis, Patricia A. Howard, and Alwyn and Donna Higgins. Said Easement is laid out to a width of twenty (20) feet, measuring ten (10) feet on either side of said above described centerline except as it may -conflict with the location of existing buildings, where the width shall be to the building line. The purpose of said Easement is to permit the City or its agents to enter onto the property as necessary to excavate for, install, replace, maintain, and use an underground sanitary sewer and appurtenant structures thereto, together with the right to ingress thereto and egress therefrom and that no building or other permanent structure shall be constructed within the limits of said Easement. There appeared at the time and place set for the meeting Irving H. and Julia S. Ayer, owners of the property at '784 Main Street; Louie P. and Laurette E. Paredis, owners of the property at 786 Main Street; and Elwyn and Homs Higgins, owners of the property at 804 Main Street. The City Engineer explained that the Interceptor Sewer is required to intercept an existing City sewer near the Town Line which presently outfalls into the Penob- scot River, and that the line will also be extended into Hampden under an Agreement between the two communities for the joint use of the Pollution Abatement Facility. It was explained that the sewer was located so that it crossed the rear and of their properties in order to provide the required clearance from an existing railroad spur track; the Maine Central Railroad Company requires 20 -foot clearance from their track for an unsleeved pipe. The City Engineer also explained the purpose of the Easement: It is only intended to allow the City to lay and to maintain a pipe under their property, and they will not lose title to their land. It was explained that the area over the pipe could continue to be used except for the construction of buildings or other permanent structures 'within 10 feet of the pipe. The City Engineer further assured those present that the ground would be restored to its original condition after the sewer has been installed. -2- Mr. Paradis asked when the line would be installed, and was advised that a construction schedule has not yet been determined; the project is presently awaiting approval by EPA. He indicated that he wished to plant a garden in the proposed construction area, and the City Engineer indicated that the Contractor would be so advised, so that perhaps the work could be scheduled after the growing season. Mr. Paradis also expressed concern about the loss of a tree, and the City Engineer indicated that damages would be paid if it were necessary to remove the tree to accommodate the construction. Mr. Higgins expressed concern that he would not have access to his shop while the sewer line was being constructed across his property, since his driveway would be completely obstructed. The City Engineer indicated that it would probably only be a day or two of interruption, and the work could be scheduled so as to interfere with his use of the shop as little as possible. The City Engineer had previous and subsequent conversations with Mr. J. R. McFarlane, Manager of Industrial Development, Real Estate and Taxation for the Maine Central Railroad Company regard- ing the proposed laying out. The location of the sewer was previously approved by MORE and arrangements will be made to complete a formal Easement Agreement with MCRA. The recommended damages for the Easement acquisition are as follows: Elwyn and Donna Higgins, Penobscot Registry of Deeds Vol. 3076, Page 272 - $375.00 Patricia A. Howard, Penobscot Registry of Deeds Vol. 27019 Page 178 - $200.00 Louie P. and Laurette E. Faradic, Penobscot Registry of Deeds Vol. 27749 Page 27 - $200.00 Irving H. and Julia S. Eyed, Penobscot Registry of Deeds Vol. 1237, Page 91 - $200.00 Maine Central Railroad Coops ny Penobscot Registry of Deeds, Vol. 1509, Page 128 -12,075.00 None of those present were opposed to the proposed laying cut, and it is recommended that the sewer Easements be laid out as described above, and as more dilly shown on Plena entitled "Town of Hampden, Maine, Construction of Interceptor Sewers, Contract No. 1" prepared by the James W. Sewall Company, Old Town, Maine, dated May, 1981 and revised February 19, 1982, a copy of which are on file in the office of the City Engineer.
