ORDERED,
THAT EIREREAS, The Bangor City Council, in its capacity as
the Municipal Officers of the City of Bangor, adopted Council
Orders 82-59 and 82-60 on January ll, 1982, whereby it authorized
and directed the City Engineer, for and on behalf of the Municipal
Officers of the City of Bangor, to layout and establish an ex-
pansion and/or extension of Bangor International Airport to acquire
and incorporate within said Airport certain properties located in
Hermon, Maine and owned by Abraham Shapiro and the Muncie I. Rogers
Heirs, all as more fully described in said Council Orders; and
WHEREAS, the City Engineer has carried out his obligations
pursuant to said Council Orders;
NOW, THEREFORE, BE IT ORDRRED BY THE CITY COUNCIL OF THE
CITY OF BANGOR, THE MUNICIPAL OFFICERS OF SAID CITY, THAT the
attached "Report of the City Engineer '__to, _' the Bangor City Council"
dated March 18, 1982, relative to the laying out and establishment
of said expansion and/or extension to Bangor International Airport
beAnd hereby is accepted.
NOW, THEREFORE, BE IT FURTHER ORDERED BY SAID CITY COUNCIL
THAT said expansion/extension of Bangor International Airport,

TO THE BANGOR CITY COUNCIL
Pursuant to Orders of the Bangor City Council, Orders 82-59 and
82-60, passed January 11, 1982, authorising and directing the City Engineer
to lay out and establish, pursuant to 6 H.R.S.A. 9f 121 at seq, and
23 M.R.S.A. 9; 3021 at seq., an expansion and/or extension of Bangor
International Airport to acquire
and incorporate within said Airport
certain land located in Herman, Maine, the City Engineer begs leave to
report:
That of his intention to lay out and establish said expansion and/or
extension of Bangor International Airport, the City Engineer gave written
notice at least seven days prior to March 15, 1982 by causing to be posted
a 'Public Notice of Layout and Taking" for the Shapiro property, so called,
and a 'Public Notice of Layout and Taking" for the Rogers property, s
called, in at least two Public places in the Town of Hermon, Maine and in
the vicinity of said expansion aM/or extension, to wit:
One each pasted on the Bulletin Baa rd at the
Town Office, Billings Road, Hermon, Maine
One each Posted an pole #038 near the end of
Fuller Road in Herman, Maine (last pole on
Fuller Road)
One each Posted on pole #025 at the intersection
of Boston Road and Fuller Brad in Hermon, Maine
In addition, a copy of said Notices were pasted, at least seven
n days prior
to March 15, 1982, on the Bulletin Hoard at Bangor City Hall, 73 Earl"
Street, Bangor, Maine and published In the Bangor Daily News, awspaper
printed and published in the City of Bangor, on March 5, 1982, ancopy of
said Orders and Notices, so Posted and published, is hereto annexed and
made part of this report.
The City Engineer met at the time and place 0£ meeting specified
in the Notices and proceeded to lay out and establish said expansion and/or
extension to Bangor International Airport, as follows:
A certain lot or parcel of lend located in
Hermon, County of Penobscot, State of Maine, on
the northerly aide of Fuller Road and the
westerly side of the Bangor 6 Aroostook Railroad
right -of -vary, more fully described as follows:
Beginning at the intersect fon of the north-
asterly,right-of-way line of Fuller Road with
the westerly right-of-way line of the Bangor 4
Aroostook Railroad; thence North 58" 26' 12"
West along said northeasterly right-of-way line
of Fuller Road for a distance of 885.61 feet to
a point( thence North IV 26' 12" West for a
distance of 2,115.90 feet to a point, being o

the generally southwesterly line of land now
r formerly owned by Grace H. M<Tigue; thence
South 55° 3714" East along the southwesterly -
line of said MCTigue property, and continuing
along the damealong the generally south-
westerly lineofland new or formerly owned by
H.T.G. Corp. as described i a Deed recorded in
Penobscot Registry of Deeds, Vol. 2212, Page
164 for a total distance of 1,827.00 feet to a
point on the westerly right-of-way line of the
Bangor A Aroostook Railroad; thence South 11°
16t 36" West along said Railroad right-of-way
line for a distance of 1,527.93 feet to the
nortbeasterly right-of-way line of Fuller Read
at the point of beginning (hereinafter referred
to a "Said Parcel"). MCBPTING therefrom such
portion of said premises
may have been veyed
by Manzie 1. Rogers toBangor Hydro -Electric Company
by Warranty Dead$ (o£ easement) dated August 24,
1955 and October 29, 1955,er corded in Penobscot
County Registry of Deeds in Volume 1497, Page 302
and Volume 1506, Page 395, respectively.
Said Parcel consists of a parcel of lend formerly owned by Abraham
Shapiro as described In Deeds recorded in Penobscot County Registry of Deeds
in Volume 1396, Page 49 and Volume 1820, Page 397, excepting therefrom that
portion of said premises acquired by the United States of America by eminent
domain recorded in Volume 1583, Page 158 of said Registry and that portion of
said premises conveyed by Abraham Shapiro to the United States of America by
Warranty Dead dated September 20, 1962, recorded in Volume 1859, Page 389 of
said Registry. Abraham Shapiro conveyed his interest in Said Parcel to the
City of Bangor by a Warranty Deed add a Release Beed, both dated March 9,
1982, recorded in the Penobscot County Registry of Deeds in Volume 3264, Pages
234 and
236, respectively.
In addition, the Said Parcel also consists of a parcel of land
formerly owed by Harris I. Rogers as described in a Deed recorded in the
Penobscot County Registry of Deeds in Volume 1246, Page 214,excepting
therefrom those portions of said promises
conveyed by Mantis I. Rogers to
Bangor Hydra -Electric Company by Deeds (Of e mens) dated August 24, 1955
and October 29, 1955, recorded in said Registry in volume 1497, Page 202 end
Volume 1506, Page 395, respectively and those portions of said premises
conveyed by Mmaie 1. Rogers to the United States of America by Warranty .Deeds
dated February 14, 1956; August 7, 1958; May 19, 1959; and October 31, 1962,
and recorded in said Registry in Volume 1520, Page 85; Volume 1637, Page 22;
Volume 1675, Page 237; and Volume 1866, Page 79, respectively. Said Massie
I. Rogers died, Intestate, in Danger, Maine on April 29, 1973, leaving the
following as his only heirs-at-law and next-of-kin: Nate Joseph Rogers (son),
Victoria G. Vassalluzzo (daughter), Diana 1. Dixon (daughter), Teresa N.
Bouscher (daughter). Rene A. Lawfer (daughter), Camil Grace Cooper (grand
daughter), Anthony DiAngelis (grandson), and Madrid DiAvgelis (grandson),
children of Frances I. DiAngelis, who predeceased her father, Wharfs I.
Rogers. Anthony DiAngelis, Teresa N. Bouscher, Diane I. Dixon, Nate Joseph
Rogers, and Massie DiAngelis have conveyed their interests in Said Parcel
to the City of Bangor by Warranty Deeds recorded in the Penobscot County
Registry of Deeds in Volume 3263, Pages 187, 189, 191, and 193 and Volume
3265, Page 321, respectively.

a Plan prepared by
the City of
Bangor Engineering Department entitled "Bangor International
Airport
Acquisition Plan -- Shapiro and Rogers Parcels",. dated March
2, 1982,
said Plan being on file in the Engineering Department.
As noted above, the City of Bangor
has acquired, by Warranty Deeds,
certain interests in Said Parcel. The above described laying out and
establishment involves the acquisition of
all outstanding interests in

appear at the time and place set for the hearing in this matter. He Submitted
the following information formy review:. (1) AppraisalReportfor Parcel No.
1, (2) Appraisal Review Letter for Parcel No. 1, (3) Appraisal Report for
Parcel No. 2, (4) Appraisal Review Letter for Parcel No. 2, (5) Names and
Addresses of the current
ent or former parties in interest for the two parcels
n question and (6)List of the interests in said parcels acquired by
City of Bangor as of March 15, 1982. Copies of these documents are

file in the Office of the City Clerk, and are incorporated herein by
reference.
Based upon the information presented, it is my recommendation and
conclusion that the total damages for the acquisition of the outstanding
interests In Said Parcel is $534.73, which should be apportioned as
follows:

Whereas Abraham Shapiro, Fate Joseph Rogers, Diane I. Sixth, Teresa
Eouscher, Anthony DiAngelia and Massie DiAngelis, an noted above, have
conveyed their interests. in Said Parcel to the City of Bangor, it is my
recommendation and conclusion that they receive no award of damages as a
result of this laying out and establishment of the expansion and/or extension
to Bangor International Airport.
As stated in the aforementioned Council Orders, Said Parcel is
being acquired for the purposes of providing unobstructed air spate and
safe approaches for the landing and taking off of aircraft, placing and
maintaining suitable markingsand lights for the safe operation thereof, and
preventing the hindrance of the proper and safe development of the use of
Bangor International Airport, its facilities and landing fields. Specifically,
it is the intent of the officials of the City of Bangor to install a high
intensity approach lighting system and an instrument landing system on o
over the property in question. Furthermore, the acquisition of Said Parcel
is in conformance with the City's policy of acquiring property located within
the "runway approach a of Bangor International Airport. The major
portions of both the Shapiro parcel and Rogers parcel, -called, are
located within said approach zone. Since the acquisition of only those
portions located within such zone would leave the Owners with a omit
remnant without road frontage o v , itrecommended that theuneconomic
of Bangor acquire all of the Shapira and Rogersparcels.

In conclusion, it i mmended that the expansion and/or
extension of Bangor International Airport be laid out and established
as described above and that anand of damages be made in accordance
with the recommendation and determination contained in this Report.

Cauvty of Penobscot,, State of Maine, on the northerly
side pffgeder Road end the westerly side of the Bangor
& Aroostook Roiliest right-of-way, more fully described

Beginning at the intersection of the northeasterly
right-of-way line of Fuller Road with the westerly
right-cf-weyllne of the Bangor & Aroostook Railroad;
thence North 580 26. 12" Rest along said northeasterly
right-af-way line of Puller Road for a distance of 885.61
feet to a point; thence North 120 24' 12" west for a
distance of 2,115.90 feet to a point, being on the generally
southwesterly line of land arm or formerly owned by Grace H.
McTigue; thence Soath 550 37' 14" Hast along the southwesterly
line of said McTigue Property, and continuing along the same

of said premtses conveyed by Manzie I. Rogers to the United States of America by
Warranty Deeds dated February 14, 1956; August 7, 19585 May 19, 19595and October 31,

interests in Said Parcel to the City of Beagor by Warranty Deeds recorded in the
Penobscot County Registry of Deeds in Volume 3263, Pages 1873 1899 191, aal 193,
Volume 3265, Page 321, and Volume 3260, Page 311, respectively.
Said Parcel is more fully shown on a Plan prepared by the City of Bangor
Engineering Department entitled "Bangor International Airport Acqulaetim Plan --
Shapiro and Rogers Parcels", dated March 2, 1982, said Plan being on file in the
Engineering Department.
As noted above, the City of Berger has acquired, by Warranty Deeds, certain
interests in Said Parcel. The above described laying Out and establishment

reference. Subsequent to sad hearing, Mr. Russell informed me that the City of Bangor
had acquired the interest of Camii Grace Cooper in and to the parcels by a Warranty
Deed dated March 16, 1982, recorded in the Penobscot County Registry of Deeds in
Volume 3268, Page 311.

system on or over the property in question. Furthermore, the acquisition of Said
Parcel is in couibrmance with the City's policy of acquiring property located within
the "nmmay approach ,One" of Bangor International Airport. The major portdons of
both the Shapiro parcel and Rogers parcel, u -called, aro located within said approach
Since the acquisition of only those portions located within such zone sould
leave the owners with an swcovonic rant without road frontage or access, it is
reoo®ended that the City of Bangor acquire all of the Shapiro and Rogers parcels.
In conclusion, it Is recommended that the expansion end/or extension of Bangor
International Airport be laid ont and established as described chose and that an
award of demages be made in accordance with the recommendation and determination

A certain lot or parcel of land situate in the Town
of Hermon, Penobscot County, State of Maine, which
was conveyed to John Ross by Cyrus News, by his deed
dated December 5, 1868, and recorded in Penobscot
Registry of Deeds, in Volume 384, Page 252, bounded
and described as follows: Beginning at a cedar stake
in the northerly line of the New County Road across
the Bog tract and the westerly line of the Bruce

lot; thence North 3- Eastthe westerly line of
the Bruce tract 121 rods tothe nrtheasterly corner
of lot no. 8 on the Bog tract to a hemlock; thence
Southeasterly on the northerly lines of said Bruce
lot and said New County Road far enough to sake 56
excepting the same deeded to John Steuart
about July 1853, by Ezekiel Farrar Jr., from the
easterly aide of the lot. Excepting however the
right of way conveyed to Bangor and Aroostook
Railroad Company.

acquired by the United States of America by eminent
domain recorded in Volume 1583, Page 158, Penobscot

conveyed by Abraham Shapiro to the United States

interests of Abraham Shapiro in and to the premises
conveyed to James A. Taylor and Abraham Shapiro by

1396, Page 49 and to Abraham Shapiro by quitclaim deed
dated January 22, 1962 and recorded in Volume 1820,
Page 397 of said Registry.

meet on Monday, March 15, 1982 at 10:00 A.M. in the office of the
City Engineer, City Hall, 73 Harlow Street, Bangor, Maine, and will
proceed to lay out and establish the aforementioned expansion and/or
extension Of Bangor International Airport and determine the damages
any person
will sustain by reason thereof aM apportion such damages,
If any,according to law.

Please be advised that by Council Order 82-60 adopted on January
11. 1982, the Bangor City Council, as the Municipal Officers of the City
Of Bangor, declared that the public exigency requires the laying out,
altering, widening, expansion and/or extension of the land and facilities
Of Bangor InCernational Airport for the purpose of providing unobstructed
air space and safe approaches for the landing and taking off of aircraft,
placing and maintaining suitable markings and lights for the safe operation
thereof, and preventing the hindrance of the proper and safe development
of the use of said Airport, its facilities and landing fields. Furthermore,
said Order authorized and directed the City Engineer, for and on behalf of
the Municipal Officers of the City of Bangor and pursuant Co 6 M.R.S.A.
