Acquire Sewer Easements - Penobscot Interceptor Sewer Extension to Hampden Town Line BY We City Conroe of City of Ban : ORDERED, THAT WHEREAS, the extension of the Interceptor Sewer system from the 'reatment Plant to intercept an existing City sewer near the Hampden Town Line is required, and WHEREAS, the City of Bangor has an existing Agreement with the Town of Hampden regarding the joint utilization of the Bangor Treatment Plant, and the sharing of the cost of said Interceptor Sewer Extension to the Hampden Town Line, and WHEREAS, the Town of Hampden has received funding to construct said Interceptor Sewer, requiring the acquisition of Easements for that portion within the City of Bangor, NOW, THEREFORE, Be It ORDERED, THAT the City Engineer, acting for and on behalf of the Municipal Officers according to law, be and hereby is author- ized to acquire Easements to permit the installation and future maintenance of the said sewer, the location of said sewer being more fully described as follows: Beginning at an existing manhole located on the Dow Field Sewer at the intersection of an existing 24 inch interceptor sewer pipe connection exIutging northeasterly to the Treatment Plant; thence deflecting 39 55' 42" westerly from a southwest- erly extension of said 24 inch interceptor sewer pipe, and extending for a distance of 19.6 feet, more or lees, to a proposed manhole located on land owned by the Maine Central Nlroad Company; thence deflecting in a northwesterly direction 31 59' 39" from the last described line and extending under an existing spur track foristance of 33 feet to a proposed man- hole; thence deflecting 81� 51' 58" in a southwesterly direction from the last described line, and extending 338 feet acroes Railroad land to a proposed manhole; thence deflecting 13 13' 21" in a westerly direction from the last described line and extending 438 feet to a proposed manhole located on the Town Line between Bangor and Hampden, said sewer crossing land owned -1- by the Maine Central Railroad Company, Irving H. and Julia S. Ayer, Louis P. and Laurette E. Heralds, Patricia A. Howard, and Elwyn and Donna Higgins; and be it further ORDERED, THAT the City Engineer proceed to give written notice of such intention of said Municipal Officers by posting notices for seven (q) days in two (2) public places in the City of Bangor and in the vicinity of the proposed acquisition; and the City Engineer is further ORDERED, TO make a return of .said proceedings containing the bounds and admeasurements of said Easements, together with a list of damages allowed for the acquisition of said Easements or for any benefits as a result of said acquisition, all in accordance with the laws of the State of Maine. STATEMENT OF FACT In accordance with a previous Agreement between Bangor and Hampden, the two communities will split the local share of the cost of approximately 580 feet of the Sewer, with the remaining section of sewer extending to the Town Line to be paid for by Hampden.
