Sylvan Road{ ....... ....... ... _ ..... _.. and sign gave notice by causing the same W be published in the BANaag DAny News, newspoper February, 19829 printed in said city, for nue week prior on the ..a0t day....of.../.............. .now of said order and notices, an pasted and imbludgai, is herein sensed andmate art of We reporh And that the said City Engineer met at the time and plate a meeting speatkd in thus notices and protected to lay, out, acid Bylvan Road as follows. —1— CENTERLINE Beginning at a point on the westerly right-of-way line of Hogan Honig said point being 169.86 feat south from a granite monument at the southerly terminus of the controlled access right-of-way of Interstate Highway I-95; thence at right angles South 830 28' 23" West for a distance of 197.34 feet to a point, being the point of curvature of a curve to the left having a radius of 1,688.46 feet; thence along said curve for a distance of 984.69 feet to a point, said point being 50 feet south from the southerly right-of-way line of Interstate Highway I-95, as measured at right angles therefrom; thence along a line parallel to, and 50 feet south from said southerly right-of-way line of Interstate Highway I-95 along a Compound curve to the right having a radius of 5,979.58 faet for a distance of 1,512.18 feet to a point, and South 64 32' 55" West along a line tangent to said curve at the last described point for a distance of 855.79 feet to a point. Said right-of-way is laid out to a total width of 100 feet, measuring 50 feet to eithir side of, and at right angles to, the above-described centerline. The first 17844 feet of said right-of-way extending west from the westerly right-of-way line of Hogan Road to the easterly line of land owned by Sylvania Electric Products, Inc. crosses - land formerly owned by the State of Maine Department of Education, transferred to the State Highway Commission in October, 19669 wherein it was designated as an unimproved State Aid road, to be maintained by the City of Bangor. From the westerly terminus of said State Aid road designation, said right-of-way crosses land owned by Sylvania Electric Products, Inc., as acquired from Albin J. Rudnicki by Deed dated October 18, 1966 and re- corded in Penobscot Registry of Deeds in Vol. 2077, Page 3, being a strip of land having a total length of 1,257.93 feet as measured from the easterly line to the westerly line of said Sylvania land, and having a width of 100 feet as measured in a southerly direction from said Interstate Highway I-95 southerly right-of-way line. The remaining portion of said right-of-way, as measured along the centerline as described above, crosses land owned by Diamond International Corp. as acquired by a Deed from the Merchants National Hank of Bangar, said Deed dated March 179 1969 and recorded in Penobscot Registry of Deeds in Vol. 2153, Page 32, said extension extending 448.07 feet westerly, as measure along said centerline, from the easterly line of said Diamond GRADE And the City Engineer proceeded to establish a grade for said roadway, as follows: Beginning at a point on the westerly edge of pavement of Hogan Road at Elevation 98.48, Bangor City Datum; thence ascend- ing on a grade of 1.00 percent for a distance of 150 feet to E1. 96.98; thence along a concave vertical curve having an -2- external of 1.56 feet for a distance of 300 feet to E1. 100.20; thence ascending on a line tangent to said curve at the last - described point on a grade of 3.16 percent for a distance of 825 feet to E1. 126.29; thence along a convex vertical curve having an external of 0.94 feet for a distance of 300 feet to E1. 131.88; thence ascending along a line tangent to said curve at the last described point on a grade of 0.58 Percent for a distance of 1,300 feet to E1. 139.42; thence along a concave vertical curve having an external of 1.26 feet for a distance of 400 feet to El. 146.98; thence ascending along a line tangent to said curve at the last described point on a grade of 3.10 percent for a distance of 295 feet to E1. 155.30. All Elevation refer to Bangor City Datum. There appeared at the time and place set for the meeting Mr. William Sanborn representing Sylvania Electric Products, Inc. The City Engineer described the proposed laying out,. and explained that the purpose of the action was to clarify the City's laying out of the roadway as a public way; the original laying out when the road was constructed in 1966 was done in cooperation with the Maine State Highway Commission, wherein the roadway was classified as an unimproved State Aid road, since the right-of-way crossed land owned by the State of Maine, being part of the Vocational School property. Since the City originally constructed the road, and has maintained it for use by the public, it is the intent of this action to formally establish the road as a public way in accordance with State law. In response to a question from Mr. Sanborn, the City Engineer advised that there would be no assess- ments levied or damages recommended as a result of the proposed laying out. Said right-of-way has previously been added to the Official City Map, and than will not require separate Planning Board review. Accordingly, it is recommended that said right-of-way be accepted as a public way for a total distance of 3,550 feet west of the westerly right-of-way line of Hogan Road, with no damages or benefits to be assessed as a result of said laying out.
