The total estimated cost of the project is 3300,000.1 of which the City's share is twenty-five percent. Councilmann Tas Jamery 19, 1982 MPORANOOM OF UNDERSTANDING 6WOOR FEDERAL RID PROJECT: OP -1570(1) t0CFTION: Hammond-Odlin-Maine Intersection RROORAI ITEM: 58_00 SCOPE OF WOR(: Traffic Operational Improvements Whereas the subject project has been included in the Capital Improvement Pm - gram, contingent on local cost sharing, it is necessary for the city of Bangor, hereinafter referred - to as the Municipality, and the Maine Department of Transportation, hereinafter referred to as the Department, to agree to a project coordination and reimbursement procedure. The Municipality must indicate their concurrence in these commitments, as out- lined, by signing the original of the Memorancum in the spaces provided and return it to the Chief Engineer, Maine Department of Transportation, Augusta, Maine 06333. This signed document most be received prior to the beginning or continue - tion of preliminary engineering activities. A. Definitions 1. Programmed Cost The programmed cost of a project is the estimated cost as shown in the Department's Capital Improvement Program. The programmed cost of this project is $300_OW. This amount is for planning purposes only, since it is based Won preliminary information. The project development process will refine this figure using more detailed information and will provide the "total estimated cast" to be used as a bests for the Rbnicipal Share." 2, Total Estimated Cost The total estimated cost of a project is the estimated cast at the completion of the project development process, includ- ing the cost of engineering, right-of-way, construction, and other items considered necessary to satisfactorily complete the project. This amount will be the basis for determining the "Fbniclpal Sham" of project cost. MEMORAMIM OF LWDERSTAMOJ o Page 2 3. Municipal Share - The Municipal Share represents the portion of the total estimated cast of a project to be made available by the Municipality. The Municipal Share of the subject project is 2% of the total estimated cost. B. ReLntureerent 1. Prior to the beginning or continuation of the project devel- umant process, the Municipality will forward a signed copy Of this Meaprandnm acknowledging that the level of the Mud- clpal financial obligation toward this project indicated adove is acceptable. 2. At the completion of project design and right-of-way . appraisal the Department will notify the Municipality of the "total estimated cost" of the project which is to be the basis of the payment expected from the Municipality. This notification will be in the form of a City/State Agreement (see paragraph C.3 below.) The project will not be adver- tised for bids until the Municipal share of the cost of the Project has been received by the State. Our current schedule calls for advertising this project in the Fall, 1984: 3. Wan receipt of the Municipality's share of the funds, the project will be advertised for bids and subsecpently the construction contract will be awerdad. Should the total estimatW cast of the project as a result of contract award be different than the "total estimated cost," which dater - mined the 'Municipal Share," then the Municipality will be responsible only for their pro -rata share of the lessor amount. MFPORANDW OF WDEVSTANOIND Page 3 1he total financial obligation of the Municipality toward this project will be completed with the action mWired by Paragraph 3. above, unless significant charges in the scope Of the construction initiated by the Municipality, or the Department and agreed to by both parties and the Federal Highway Administration result in an increase in the "total estimated cost." In which case, the Municipality is expected to pay their pro -rata portion of the increased cost. Project Development _ 1. The Cepartment, during the project public participation process, Will arrange for a meeting with the officials of the Municipal- ity, if desired by the Municipality, to review the project limits, scope of work, etc., based on the best information avail- able at that tima. 2. Additional reviews may ho requested by either the Municipality or the Department at any point in the project development process. 3. A City/State Agreement will be prepared by the State formalizing the funding and will outline the work to be done by the State and that which is to be performed by the Municipality. 6. The Municipality and the Cepartment retain the right to terminate the project at any time prior to the actual acquisition of right- of-way. Projects cannot be terminated by the Municipality subse- quent to right-of-way, acquisition without concurrence by the Department. a. Projects terminated by the Municipality The Municipality shall be responsible for the entire norvfederal share of the tag expenditures Incurred against the project at the time of termination. Projects termireted by the Department The Department shall be responsible for the entire non-federal share of the total expeMitures incurred against the project at the time of termination. i c. Projects terminated by Mutual Agreement The Municipality and the Department will share propor- tionately, as with total project funding, in the respons- ibility for the non-federal share of the total expendi- tures incurred against the project at the time of termination.
