HomeMy WebLinkAbout1982-01-25 82-66 ORDER02-66 Introduced by Councilor 2endmian, January 25, 1902 CITY OF BANGOR (TITLE.) &Drgr, Directing City Engineer to Lay O1.ut and Establish Sylvan Road as a Public Way Ry tAe City CinnusR oftAe atyofBanyor: ORDERED, THAT, WHEREAS, Sylvan Road, extending west from Hogan Road, has never been officially accepted as a public way, nor added to the Official City Map for its entireconstructedlength, and WHEREAS, said street has previously been constructed to acceptable City standards and has been used by the public for access across land owned by the State of Maine to the property of Sylvania, Inc. and Diamond International Corp., and WHEREAS, it is in the best interests of the City of Bangor to formally establish said street as a public way, NOW, THEREFORE, be it ORDERED, THAT the City Engineer, acting for and on behalf of the Municipal Officers according to law, be and hereby is directed to lay out by metes and bounds and establish a right- of-way for said roadway, the centerline of which is described as follows: - Beginning at a point on the westerly right-of-way line of Hogan Road, said point being 169.86 feet south from a granite monument at the southerly terminus of the controlled access right-of-way of Interstate Highway 1-95; thence at right angles South 830 28' 23" West for a distance of 197.34 feet to a point, being the point of curvature of a curve to the left having a radius of 1,688.48 feet; thence along said curve for a distance of 984.69 feet to a point; thence along a compound curve to the right having a radius of 59979.5$ feet for a distance of 11512.18 feet to a point; thence South 64 32' 55" West along a line tangent to said curve at the last described point for a distance of 855.79 Peet to a point. Said right-of-way to have a total width of 100 feet, measuring 50 feet to either side of, and at right angles to, the above described centerline. And be it further ORDERED, THAT the City Engineer proceed to give notice of such intention of said Municipal Officers according to law by -1- posting such notice for seven (9) days in two (2) public places in the City of Bangor and in the vicinity of the proposed roadway, and the City Engineer is further ORDERED, TO make a written return of said proceedings con- taining the bounds and admeasurements of said right-of-way and the damages allowed to any, person or persons as a result of said laying out, all in accordance with the laws of the State of Maine, and be it further ORDERED, THAT consideration be given to adding said right- of-way to the Official City Map in accordance with the provisions of Chapter II, Article 12, Section 6 of the Laws and Ordinances of the City of Bangor. STATEMENT OF FACT Sylvan Road was originally constructed by the City of Bangor to serve Sylvania, Inc. Because most of the roadway, crossed land owned by the State of Maine (EMVTI), and the urgency of caresses tion did not permit the normal transfer of land to the City by the State, the right-of-way was laid out by the State as a State Aid Road. The subsequent extension to Diamond International was also not formally accepted as a, public way, which necessitates the above action. - bL 82-66
