By the City Cousae of Gee City of Bangor:
ORDERED,
THAT WHEREAS, public exigency requires the laying out, altering,
widening, expansion and/or extension of the land and facilities of the
Bangor International Airport for the purposes of providing unobstructed
r space and safe approaches for the landing and taking off of aircraft,
placing and maintaining suitable markings and lights for the safe opera-
tion thereof, and preventing the hindrance of the proper and safe develop-
ment of the use of said Airport, its facilities and landing fields; and
-WHEREAS, Title 6 M.R.S.A. §§ 121 and 122 and Title 23
M.R.S.A. IS 3021 en sea. authorize the municipal officers of a munici-
pality to lay out, alter, widen, expand or extend a municipality's
airport or landing fields and, as a matter of public exigency, to take
land by eminent domain for such purposes; and
WHEREAS, Title 23 M.R.S.A. § 3022 authorizes the municipal
officers of a municipality to lay out, alter, widen or expand an airport
or landing field by agency;
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE
CITY OF BANGOR THAT:
1. The City Engineer, acting for and on behalf of the
Municipal Officers of the City of Bangor according to law, be and hereby
is authorized and directed to lay out by metes and bounds and establish
an expansion and/or extension of Bangor InternationalAirport to acouire
and incorporate within said Airport all of the land, buildings thereon,
r rights, and easements (except as noted in the description below)
within the following described premises:
A certain 1°t orparcelof land situate in the
Town of Hermon, Penobscot County, State of Maine,
which was conveyed to John Rosa by Cyrus Hews, by
his deed dated December 5, 1868, and recorded in
Penobscot Registry of Deeds, in Volume 384, Page 252,
bounded and described as follows: Beginning at a
cedar stake in the northerly line of the New County
Road across the Bog tract and the westerly line of the

Bruce lot; thence North 30 East on the westerly line
of the Bruce tract 121 rods to the northeasterly corner
of lot no. 8 on the Bog tract to a hemlock; thence
Southeasterly on the northerly lines of said Bruce lot
and said New County Road far enough to make 56 a , ex-
cepting the same deeded to John Stewart about July 1853,
by Ezekiel. Farrar Jr., from the easterly sideof the lot.
Excepting however the right of way conveyed to Bangor and
Aroostook Railroad Company.
Excepting that portion of the subject premises acquired
by the United States of America by eminent domain recorded
in Volume 1583, Page 158, Penobscot Registry of Deeds.
Excepting that portion of the subject premises conveyed by
Abraham Shapiro to the United States of American by Warranty
Deed dated September 20, 1962 and recorded in Volume 1859,
Page 389, Penobscot Registry of Deeds.
Meaning and intending to authorize the laying out and
establishment of an extension and/or expansion of Bangor International
Airportto acquire
and incorporate within said Airport all outstanding
interests in the Same premises conveyed to James A. Taylor and Abraham
Shapiro by warranty deed dated June 4, 1953, recorded in Volume 1396,
Page 49 and to Abraham Shapiro by quitclaim deed dated January 22, 1962
and recorded in Volume 1820, Page 397, Penobscot County Registry of Deeds.
2. The City Engineer is hereby authorized to take all
action deemed necessary or appropriate to accomplish the aforesaid
laying out and establishment, including, but not limited to, the giving
of notice as required by statute; and
3. The City Engineer make a written return of said pro-
ceedings containing the bounds and admeasurements of said Airport
extension and/or expansion and the damages allowed to any person(s)
which mayarise as aresult of said layingcout and establishment of
said extension and/or expansion, all inaccordancewith the Laws of
the State of Maine; and
4. The City Solicitor, or his representative, is hereby
authorized to represent and assist the City Engineer in the accomplish-
ment
