MWLVBD, THAT the City of Bangor, Maine acquire by eminent domain,
.in accordance with 30 M.R.S.A. § 4854 and pursuant to its duly adopted
Community Development Program, all the right, title, interest, or
estate of the above-mentioned persons, and all persons claiming an
interest under or throughsaidpersons, in and to a certain lot or
parcel of land located in the City of Bangor, County of Penobscot, State
of Maine, bounded and described as follows, viz.
Beginning at a point on .the southwesterly right-of-way line
of Spruce Street at the -northwesterly line of land now or formerly
caned by Eastern Maine Medical Center, said point being 34.32
feet northwest from the northwesterly right-of-way line of
Hancock Street Extension, as laid out and recorded in Penobscot
for a distance. of 100 feet to a point, being at the intersection
of the southeasterly line of a lot now or formerly owned by
Freeman A. Robinson;, thence South 63° 08' 56" West along the
southeasterly line of said Robinson lot for a distance of 110
feet to a joint, being on the northeasterly line of land now or
formerly owned by Maine Vest, Inc.; thence South 260 34' 44"
East alongthe northeasterly line of said Maine Vest, Inc. lot
for a distance of"79.60 feet to the northeast corner of land now
or formerly owned by Mary Thibodeau Heirs; thence continuing
along the same course
along the northeasterly line of said lot
of Mazy ThibodeauHeirs for a distance of 20.40 feet to the
northwesterly line of land now or formerly owned by the Eastern
Maine Medical Center; thence North 630 08 56" East along the
northwesterly line of said Eastern Maine Medical Center Property
for a distance of 110 feet to thecolorof beginning.

Being a portion of the premises conveyed to Ellen Cassidy by
Charles
W. Roberts at als. by deed dated August 3, 1885 and
recorded in the Penobscot County Registry of Deeds in
Volume
555, Page 406. Said portion being depicted as Lots 6
and 7
on a plan prepared by P. H. Coombs, C.E. dated November 16,
1898 and recorded in the Penobscot County Registry of
Deeds
on December 20, 1906 (Plan Book 7, Page 37).
AMC BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF
BANGOR THAT the total amount of damages determined to be just
compen-
sation for the acquisition of the above-described o operty
is Four
Thousand Five Hundred Thirteen and 00/100 Dollars ($4,513.00).
AND BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF
BANGOR THAT said amount of just compensation for the acquisition of
said property be apportioned as follows:

AND BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BANGOR THAT the City Solicitor,
or his agent, is hereby authorized
and directed to take all
action deemed necessary and/or appropriate
for the purpose of submitting
this Resolve to the legislative body of
the City of Bangor for approval or disapproval.
STATEMENT OF FACT: The Bangor City Council passed Council Order 196 AH
on Me 28, , in which
it authorized the acquisition of Parcel 55-156
for the establishment of
a public right -o£ -way and the construction of
a street thereon to connect
Pearl Street and Spruce Street.
The property in question
comprises a portion of the real estate con-
veyed to Ellen Cassidy by
Charles W. Roberts et als, by deed dated
August 3, 1885, and recorded in the Penobscot County Registry of Deeds
in Volume 555, Page 406.
The interests of various heirs of Ellen
Cassidy have been extinquished over the years by a number of tax
deeds r orded in favor of the City of Bangor. Since 1942, the
property in question has been assessed to heirs or grantee(s) of
heirs of William J. Cassidy (son of Ellen Cassidy). The heirs or
grantees of heirs assessed at present [Rita M. Adams (formerly
Rita M. Cassidy), M. Eileen Cassidy, and Frances Cassidy, (widow
of W. Adrian Cassidy, Sr.)] have informally accepted the City's offer
to purchase their interests in the property for a total am of
$4,500.00. The purpose of this eminent domain action is to acquire
,all outstanding interests, if any, in said property which may not have
been extinguished by the aforementioned tax deeds.
