`-ORDERED,-
THAT WHEREAS, the Bangor City Council designated the Congrega-
tion Beth Abraham Anshe Sphard (hereinafter "Developer") as the tenta-
tive developer of Parcel H -1(a) by passage of Council Resolve 205 AN
on June 9, 19801 and -
WHEREAS, the Bangor City Council Finance Committee has deter-
mined that the fair reuse value of said parcel is $.45/square foot; and
WHEREAS, the redevelopment proposal submitted by the Developer
received approval on August 10, 1981 from the Design Review and Site
Plan Review Committee pursuant to the duly approved and adopted Community
Development Program Redevelopment Plan for the Hancock -York Neighborhood
Development Project said approval being subject to certain conditions;
and
WHEREAS, said Conditions have been met;
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY
OF BANGOR THAT the City Manaper is hereby authorized to execute a Release
Deed in favor of the Developer and to deliver the same to the Developer
upon receipt of the purchase price of $3,929.40, a copy of said Release
Deed being on file in the Office of the City Clerk.
STATEMENT OF FACT: The above -referenced conveyance to Congregation Beth
xa aAb�ppHard. will complete the final phase of the land conveyances
involved in the redevelopment of Community Development Parcel H-1. The
City of Bangor and the Congregation previouslye xchanged two parcels in
this area to facilitate the development of "TheTerraces" project on Parcel
H-1. The value of $.45/square foot has been used throughout the land
exchange process. The redevelopment prsal referred to above consists
of the development of'a "mini -park" onp

RELEASE DEED
CITY OF BANGOR, a municipal corporation located in the City
of Bangor, County of Penobscot, State of Maine (hereinafter
"Grantor"), for consideration paid, releases to CONGREGATION
BETH ABRAHAM ANSHE SPHARD, a Maine Corporacion, of Bangor, County
of Penobscot, State of Maine, the land in said Bangor, bounded
and described as follows, vu.
A certain parcel of land bounded on the North by York Street, on
the East by land of the Grantee, on the South by land of G b S
Terrace Associates, and an the West by Essex Street, more fully
described as follows: Beginning at the intersection of the
easterly right-of-way line of Essex Street with the southerly
right-of-way line of York Street; thence N. 60' 18' 48"'E!'along
the southerly right-of-way line of York Street for a distance of
94.11 feet to a point, being the westerly line of land awned by
the Grantee; thence S. 11' 24' 23" E along the westerly line of
the Grantee for a distance of 100.00 feet: thence S. 600 18'
48" W. for a distance of 89.82 feet to the easterly line of Essex
Street; thence N 13' 46' 12" W. along the easterly right -o£ -way
line of Essex Street for a distance of 98.74 feet to the point
of beginning. The above described parcel contains 8,732 square
feet.
This conveyance is made upon the following express conditions
covenants and restrictions, for breach of which said GRANTOR may
enter and Fevest in itself title to the premises granted hereby
as if this deed had never been given, or exercise any other
remedies hereinafter set forth; itbing the intent that the con-
veyance of the aforedescribed property to the GRANTEE is made
upon a condition subsequent.
GRANTEE covenants and agrees by and for itself, its suc-
cessors and assigns, and all persons or entities claiming under or
equitable, for the enforcement of the terms and conditions of
this conveyance.
PROVIDED, HOWEVER, that any delay by the GRANTOR in institu-
ting or prosecuting any such actions or proceedings or otherwise
asserting its rights hereunder shall not operate as a waiver of
such rights and shall not operate to deprive it of or limit such
rights in any way.

IN WITNESS WHEREOF, the CITY OF BANGOR, GRANTOR herein, has
caused this Deed to be signed, acknowledged, and delivered in its
name and behalf by John W. Flynn, its City Manager, thereunto

CONGREGATION BETH ABRAHAM ANSHE SPHARD, the GRANTEE herein, has
caused this Deed to be signed,acknowledged, and delivery accepted
