Title, Order
Authorizing the City Manager to Sign Such Leases, Memoranda of Understanding, and Agreements as are
Necessary to Respond to the COVID-19 Pandemic
This Order would authorize the City Manager to execute leases, memoranda of understanding, and
other agreements in order to assist in the response to the COVID 19 pandemic.
Under Chapter 28 of the City Code, the City Manager has broad powers to create regulations in
response to emergencies such as COVID-19. There is no explicit granting of authority to enter into
leases and other agreements, however. As the City continues to respond to the pandemic, there
may be a need to act quickly on such agreements. Examples may include leases of spaces to set up
facilities for people who are in quarantine, or agreements with agencies and other organizations to
provide services such as the Bass Park testing facility.
Given the immediate threat of the pandemic, this Order is being introduced as an emergency
measure pursuant to Article V, Section 1 of the Bangor City Charter.

Necessary to Respond to the COVID-19 Pandemic
WHEREAS, on March 16, 2020, after consultation with the Chair of the City Council, the City Manager declared
and signed a "Proclamation Declaring State of Emergency";
WHEREAS, this followed a declaration by the Governor of the State of Maine of a civil state of emergency on
March 15, 2020;
WHEREAS, the City's Proclamation Declaring State of Emergency was renewed by the City Council on March
19, 2020;
WHEREAS, as of noon on March 22, 2020, there are 89 confirmed cases of COVID-19 in the State of Maine;
WHEREAS, the number of confirmed cases in the State of Maine of COVID-19 is increasing rapidly;
WHEREAS, the COVID-19 emergency persists and grows throughout the City, the State of Maine, the United
States of America, and the world; and
WHEREAS, these factors present an immediate threat to the public health and safety, and require the City to
be able to react quickly as additional information and resources become available;
Be it Ordered by the City Council of the City of Bangor that,
1. The City Manager is hereby authorized to execute such leases, memoranda of understanding, contracts,
and other agreements as she deems are reasonably necessary to respond to the COVID-19 pandemic.
2. The ongoing COVID-19 pandemic, combined with the need for immediate action to prevent or mitigate the
further spread of the disease, constitutes an emergency, and the actions contemplated in this Order are
therefore immediately necessary for the preservation of the public peace, health or safety. This Order is
therefore enacted as an emergency measure pursuant to Article V, Section 1 of the Bangor City Charter.
