Authorizing Acceptance of Quitclaim Deed and Execution of Municipal Quitclaim Deed - Real Estate Located at
178 Ohio Street
On June 8, 1998, the City of Bangor took possession of a lot then known as Tax Map 32, Lot 100A
and then being 186 Ohio Street. In 2002, the abutters to that lot were Erlene M. Morgan (at 178
Ohio Street) and Larry A. Carr (at 190 Ohio Street). At that same time, the City of Bangor attempted
to divide the 186 Ohio Street lot in two by deeding, with restrictions, the northerly portion to Larry
Carr and the southerly portion to Erlene Morgan. Unfortunately, the City deeded the southerly
portion of the 186 Ohio Street property twice: first to Larry Carr and then to Erlene Morgan.
To fix the title issues to the southerly portion that the above, the City must now accept a quitclaim
deed from Jeffrey H. Beardsworth and Gertrude A. Beardsworth, who are successors in title to Larry
A. Carr, and execute a quitclaim deed to Erlene Morgan, who still owns the 178 Ohio Street property.
This order is associated with another order relating to Tax Map 32, Lot 101.

Authorizing Acceptance of Quitclaim Deed and Execution of Municipal Quitclaim Deed - Real Estate Located at
178 Ohio Street
WHEREAS, the City of Bangor took possession of 186 Ohio Street on or about June 9, 1998,
WHEREAS, on or about January 9, 2002, the City mistakenly released, with restrictions, the southern portion
of the 186 Ohio Street property to the northern abutter,
WHEREAS, on or about February 14, 2002, the City attempted to release, with restrictions, the southern
portion of the 186 Ohio Street property to the southern abutter,
WHEREAS, the deed to the southern abutter could not be affective because of the City had already released
its interests to the northern abutter,
WHEREAS, the current northern abutters, Jeffrey H. Beardsworth and Gertrude A. Beardsworth, approached,
through counsel, the City to to fix the title issue,
WHEREAS, the current southern abutter, Erlene M. Morgan, spoke to the Assistant City Solicitor and agrees to
fix the title issue,
WHEREAS, to fix the title issue, the City must first accept a quitclaim deed from Jeffrey H. Beardsworth and
Gertrude A. Beardsworth, and then execute a municipal quitclaim deed to Erlene M. Morgan,
NOW THEREFORE, be it Ordered by the City Council of the City of Bangor that:
1. The City of Bangor is authorized to accept a quitclaim deed from Jeffrey H. Beardsworth and
Gertrude A. Beardsworth in form and substance approved by the City Solicitor or Assistant City
Solicitor, and
2. Deborah A. Laurie, Finance Director, is hereby authorized and directed, on behalf of the City of
Bangor, to execute a Municipal Quitclaim Deed releasing any interest the City may have by
virtue of notice of possession recorded in the Penobscot County Registry of Deeds in Book 6727
Page 66, or the tax and sewer liens mentioned therein, to Erlene M. Morgan. Said Deed shall
be, in form and substance, approved by the City Solicitor or Assistant City Solicitor.
Said Deed shall contain any and all restrictions of the prior, potentially ineffectual, deed to said
Erlene Morgan that was recorded in the Penobscot County Registry of Deeds in Book 8080,
Page 155.
