Authorizing Execution of a Contract with S.E. MacMillan in the Amount of $31,777,777 for the Construction of
the Davis Brook CSO Storage Tank
This order would authorized the execution of a contract with S.E. MacMillan in the amount of
$31,777,777 to construct a 3.8 million gallon storage tank along the Penobscot River.
On December 5, 2019, the City received three bids for this project ranging in price from $31,777,777
to $34,214,250 for the base project bid.
This project will provide additional capacity to further reduce the number of discharges to the
Penobscot River of combined sewer overflows (CSO) that occur within the City's system during high
flow events (i.e. rain, snow melt). This investment is required to ensured continued compliance with
the City's consent decree with the Federal EPA and Maine DEP.
The City will engage in value engineering to identify potential costs savings to this project.
This project is expected to be financed through the Maine Municipal Bond Bank Clean Water Fund,
which provides low cost financing for qualified projects. In addition, this project qualified for $2
million of principal forgiveness and a $1 million grant through this program.
This project meets the Council goal of improving water quality through compliance with the Clean
Water Act.

Whereas; the City of Bangor is party to a Consent Decree with the Federal Environmental Protection Agency;
and
Whereas; the reduction of Combined Sewer Overflow (CSO) events within the City's system is a requirement
of the Consent Decree; and
Whereas; the construction of a 3.8 million gallon storage tank along the Penobscot River was identified as a
necessary investment to reduce the number of CSO events;
Be it Ordered by the City Council of the City of Bangor that, the Finance Director is hereby authorized to
execute a contract with S.E. MacMillan in the amount of $31,777,777 to construct the Davis Brook CSO
storage tank.
